Nothing in the Oklahoma Carbon Capture and Geologic\n\nSequestration Act shall supersede the provisions of the Oklahoma\n\nCarbon Sequestration Enhancement Act, Section 3-4-101 et seq. of\n\nthis title.\n\nB. Nothing in the Oklahoma Carbon Capture and Geologic\n\nSequestration Act shall alter the incidents of ownership, or other\n\nrights, of the owners of the mineral estate or adversely affect\n\nenhanced oil or gas recovery efforts in the state.\n\nC. Any right granted to a facility operator pursuant to the\n\nOklahoma Carbon Capture and Geologic Sequestration Act shall be\n\nwithout prejudice to the rights of any surface owner or mineral\n\nowner, including a working interest and royalty owner, well\n\noperator, and gas storage operator of the land encompassed within\n\nthe defined geographic boundary of the CO2 sequestration facility or\n\na CO2 storage unit permitted or authorized by the Corporation\n\nCommission, to drill or bore through the approved reservoir in a\n\nmanner as shall comply with orders, rules and regulations issued for\n\nthe purpose of protecting the approved reservoir against the escape\n\nof CO2. The surface estate is servient to the dominant mineral\n\nestate for the purposes of oil and gas development.\n\nD.
