Stat. tit. 27A, § 27A-3-5-111","heading":"Energy produced from bioenergy feedstocks and","body":"agricultural harvesting—Carbon neutral and carbon negative\n\ndetermination.\n\nA. As used in this section:\n\n1. “Biomass” means bioenergy feedstocks from forest products\n\nmanufacturing, which may include but not be limited to:\n\na. forest products’ manufacturing residuals including but\n\nnot limited to spent pulping liquors, pulping by-\n\nproducts, woody manufacturing residuals, paper\n\nrecycling residuals, wastewater and process water\n\ntreatment plant residuals, and anaerobic digester\n\nbiogas,\n\nb. harvest residues, including trees or portions of\n\nharvested trees that are too small or too poor of\n\nquality to be utilized for wood or paper products,\n\nc. downed wood from extreme weather events or natural\n\ndisasters, nonhazardous landscape or right-of-way\n\ntrimmings and municipal trimmings, and plant material\n\nremoved for purposes of invasive or noxious plant\n\nspecies control,\n\nd. biowaste, including landfill gas,\n\ne. forest biomass derived from residues created as a by-\n\nproduct of timber harvesting,\n\nf. forest management activities conducted for strand\n\nimprovement or to increase yield, ecological\n\nrestoration, or to maintain or enhance forest health,\n\ng. biomass materials recognized by the United States\n\nEnvironmental Protection Agency as fuels under 40 CFR\n\npart 241.4, and\n\nh. other used wood products, such as crates or pallets;\n\n2. “Bagasse biomass” means the solid, heterogeneous, and\n\nfibrous agricultural waste that remains after extracting the liquid\n\nfrom sugarcane stalks. Such waste may derive from:\n\na. factory bagasse, obtained from the industrial\n\nextraction process, containing only trace amounts of\n\nsugarcane liquid, or\n\nb. pressed cane stalks or farm bagasse, obtained from on-\n\nfarm or small factory extraction, containing\n\ncomparatively higher amounts of sugarcane liquid; and\n\n3. “Bioenergy with carbon capture and storage” means the\n\nprocess of capturing and permanently storing carbon dioxide from\n\nbiomass energy generation.\n\nB. Energy produced from bioenergy feedstocks from forest\n\nproducts manufacturing shall be considered renewable and carbon\n\nneutral. When bioenergy is paired with carbon capture and storage,\n\nas described in paragraph 3 of subsection A of this section, such\n\nenergy shall be considered carbon negative.\n\nC. Energy produced from agricultural harvesting, including\n\nbagasse produced from sugarcane processing shall be considered\n\nrenewable and carbon neutral.
