Stat. tit. 27A, § 27A-4-1-102","heading":"Definitions","body":"For purposes of the Oklahoma Emergency Response Act:\n\n1. \"State environmental agency\" includes:\n\na. the Oklahoma Water Resources Board,\n\nb. the Corporation Commission,\n\nc. the State Department of Agriculture,\n\nd. the Oklahoma Conservation Commission,\n\ne. the Department of Wildlife Conservation,\n\nf. the Department of Mines and Mining,\n\ng. the Department of Public Safety,\n\nh. the Department of Labor,\n\ni. the Department of Environmental Quality, and\n\nj. the Department of Civil Emergency Management;\n\n2. \"Lead official\" means the person designated by the contact\n\nagency to be the official in charge of the on-site management of the\n\nemergency;\n\n3. \"Emergency\" means a sudden and unforeseeable occurrence or\n\ncondition either as to its onset or as to its extent, of such\n\nseverity or magnitude that immediate emergency response or action is\n\nnecessary to preserve the health and safety of the public or\n\nenvironment or to preserve property;\n\n4. \"Dangerous substance\" means explosives, gases, flammable\n\nliquids and solids, poisons, radioactive materials, hazardous\n\nmaterials, deleterious substances, oil, or other substance or\n\nmaterial in a quantity or form capable of posing an unreasonable\n\nrisk to public health and safety, property or to the environment;\n\n5. \"Release\" means a leakage, seepage, discharge, emission or\n\nescaping of a dangerous substance into the environment of the state;\n\n6. \"Extreme emergency\" means any emergency which requires\n\nimmediate protective actions;\n\n7. \"Protective actions\" are those steps deemed necessary by\n\nfirst responders to an extreme emergency to preserve the health and\n\nsafety of the emergency responders, the public and the protection of\n\nthe environment and property during an incident involving the\n\nrelease of a dangerous substance. Protective actions include but\n\nare not limited to area isolation, evacuation, dilution, cooling,\n\nencapsulation, chemical treatment and diking;\n\n8. \"First responder\" means the first person to arrive at the\n\nscene of an incident involving the release of a dangerous substance\n\nwho has the authority by virtue of that person's position as a local\n\nlaw enforcement officer, peace officer, fire protection officer or\n\nOklahoma Highway Patrol Officer or other law enforcement officer;\n\n9. \"Contact agency\" means a municipality, fire department or\n\nthe Oklahoma Highway Patrol as determined by the location of an\n\nincident as follows:\n\nLocation Contact Agency\n\na. Inside corporate municipal Municipal Fire\n\nlimits Department\n\nb. Outside corporate Closest Municipal\n\nlimits on private property Fire Department\n\nc. Outside corporate limits Oklahoma Highway\n\non federal/state highway, Patrol;\n\npublic property, county road,\n\nor a railroad;\n\n10. \"Responsible party\" means any person who owned, operated,\n\nor otherwise controlled activities at the facility at the time the\n\nincident or event involving releases of dangerous substances\n\nrequiring protective actions occurred; and\n\n11. \"Facility\" means:\n\na. any building, structure, installation, equipment, pipe\n\nor pipeline, including any pipe into a sewer or\n\npublicly owned treatment works, well, pit, pond,\n\nlagoon, impoundment, ditch, landfill, storage\n\ncontainer, motor vehicle, rolling stock, or aircraft,\n\nor\n\nb. any site or area where a hazardous substance has been\n\ndeposited, stored, disposed of, or placed, or\n\notherwise came to be located, or\n\nc. any vessel, including every description of watercraft\n\nor other artificial conveyance used, or capable of\n\nbeing used, as a means of transportation on water.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"166affbf759f5cdf3d1a24cbe1c142a70a3255fd5a4b063a00a53dbe9bb16e73","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-4-1-101","next":"us-ok/okla.-stat.-tit.-27a-27a-4-1-103"},"notice":"GroundRules: Original legal text.
