Stat. tit. 28, § 28-101","heading":"Fees and costs in criminal cases part of penalty -","body":"Enforcement by imprisonment - Persons unable to pay.\n\nThe fees herein provided for the clerk of the district court and\n\nthe sheriff, as provided in this section, and all costs in the\n\nprosecution of all criminal actions shall, in case of conviction of\n\nthe defendant, be adjudged a part of the penalty of the offense of\n\nwhich the defendant may be convicted, whether the punishment for\n\nsuch offense be either imprisonment, or fine, or both, and fixed\n\neither by the verdict of the jury, or judgment of the court, trying\n\nthe case, and if the defendant shall refuse to pay the court\n\nfinancial obligations, the payment of such fees and costs, in\n\naddition to the payment of the fine assessed, shall be enforced by\n\nimprisonment until the same shall be satisfied at a rate of up to\n\nOne Hundred Dollars ($100.00) per day of such fees and costs, or\n\nfine, or both, or shall be satisfied at a rate of up to Two Hundred\n\nDollars ($200.00) per day of such fees and costs, or fine, or both,\n\nshould the defendant perform useful labor. If the defendant is\n\nwithout means to pay the fine, fees or costs, the total amount owed\n\nmay be entered as a judgment and thereupon the same remedies shall\n\nbe available for the enforcement of the judgment as are available to\n\nany other judgment creditor.\n\nThe term “all costs in the prosecution of all criminal actions”,\n\nas used in this section, shall include all court financial\n\nobligations as defined in Section 983 of Title 22 of the Oklahoma\n\nStatutes.\n\nR.L. 1910, § 3196.
