In all cases or proceedings in the district courts or other\n\ncourts of record, in which notice by publication is required or\n\nrequested, the court clerk at the time of the filing of the petition\n\nshall:\n\n1. Collect a deposit in the sum of Twenty-five Dollars ($25.00)\n\nwhich shall be in addition to all other fees required by law and\n\nshall be used only for the purpose of paying the publisher's fee for\n\npublishing such notice or notices; or\n\n2. Accept proof of a direct billing agreement between a\n\npublisher authorized to publish such notice or notices and the\n\nperson filing the petition. Proof of such an agreement may consist\n\nof a list of persons with whom a publisher has such an agreement\n\nwhich shall be provided by the publisher to the court clerk and\n\nupdated no more often than monthly nor less often than annually or\n\nby a letter from the publisher addressed to the court clerk stating\n\nthe existence of such an agreement.\n\nB. In the event it cannot be ascertained at the time the\n\npetition is filed that notice by publication will be required or\n\nrequested and the required deposit for publication is not paid at\n\nthat time, the court clerk shall, upon the filing of an affidavit\n\nfor service by publication, a verified petition or any other\n\npleading requiring notice by publication, follow the procedure\n\nprovided in subsection A of this section to secure payment for the\n\npublication.\n\nC. Any deposit or part thereof which is not actually charged\n\nfor publication costs shall be refunded.\n\nD. Prior to accepting any final decree or dismissal for filing\n\nin any case in which notice by publication is required or requested,\n\nthe court clerk shall collect for transmittal to the publisher such\n\nfees as are necessary to pay for all costs of publication or have on\n\nfile a statement or receipt from the publisher that the same have\n\nbeen paid and, provided further, that proof of publication shall be\n\nheld by the court clerk but not filed until such time as such\n\npublication fees have been collected in full or such statement or\n\nreceipt from the publisher that the same have been paid has been\n\nfiled.","path":["OK Code","Title 28"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os28.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b299c6cb0526a2fcf7a7083791f6a3ebcb9f8edc4dc2e97ef4d8551f67b3db83","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-28-28-155.1","next":"us-ok/okla.-stat.-tit.-28-28-157"},"notice":"GroundRules: Original legal text.
