Whenever, under the laws of this state, a person may be\n\ncompelled by order, subpoena, or other lawful compulsion to appear\n\nas a witness, whether or not testimony or other evidence is actually\n\nadduced, the witness shall receive the following:\n\n1. For a witness who appears from another state or foreign\n\ncountry in a criminal proceeding in this state, the amount specified\n\nin Section 718 of Title 22 of the Oklahoma Statutes;\n\n2. For a witness who appears from this state in a criminal\n\nproceeding in another state, the amount specified in Section 722 of\n\nTitle 22 of the Oklahoma Statutes;\n\n3. For a witness who appears from this state pursuant to an\n\norder, subpoena, or other lawful means for compelling the appearance\n\nof the witness, Ten Dollars ($10.00) for each day of attendance,\n\nplus reimbursement as prescribed by law for travel expenses at rates\n\nnot to exceed those prescribed by law for reimbursement for state\n\nemployees.\n\nB. In computing mileage allowances for witnesses, parts of a\n\nmile shall be rounded to the nearest whole number of miles. Where\n\nthe total mileage actually and necessarily traveled is less than one\n\nand one-half miles, no mileage shall be allowed.\n\nC. No witness shall receive per diem or mileage in more than\n\none case covering the same period of time, or the same travel, and\n\neach witness shall be required to make oath that the fees claimed\n\nhave not been claimed or received in any other case, and no juror\n\nwhile serving as a juror or party to a civil action shall receive\n\ncompensation as a witness.\n\nD. The fees and expenses allowed by this section shall be paid\n\nas follows:\n\n1. In civil cases, the fees for one day's attendance shall be\n\npaid pursuant to Section 2004.1 of Title 12 of the Oklahoma Statutes\n\nand fees for subsequent attendance shall be paid on the day before\n\neach additional day of attendance unless the witness agrees to\n\nanother time for payment;\n\n2. In criminal cases, the witness shall be paid at the\n\nconclusion of each day of attendance unless the witness agrees to\n\nanother time for payment; or\n\n3. In all other cases, the witness shall be paid at the\n\nconclusion of attendance unless the witness agrees to another time\n\nfor payment.\n\nE. Any error in computing the number of miles allowable shall\n\nnot be sufficient grounds for failure to obey the order, subpoena,\n\nor other lawful compulsion if a per diem has been tendered to the\n\nwitness.\n\nF. A person who is compelled to appear as a witness pursuant to\n\nsubsection A of this section to give factual testimony in any civil\n\nproceeding other than one in which the state is a party, but therein\n\nqualifies and testifies as an expert witness, shall receive a\n\nreasonable expert witness fee from the party seeking the expert\n\ntestimony in addition to the fees required pursuant to subsections A\n\nand B of this section.","path":["OK Code","Title 28"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os28.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"888cef8b0aee1beadf332373eb4fe115b8364a942dfd603a0099fdbf839ff88c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-28-28-8","next":"us-ok/okla.-stat.-tit.-28-28-82"},"notice":"GroundRules: Original legal text.
