Any employee of the state or any political subdivision\n\nthereof who is subpoenaed as a witness to testify on any matter\n\npertaining to their employment, including any investigation\n\nconducted by the employee as a duty of said employment for which he\n\nis fully compensated, shall not be entitled to receive the witness\n\nfee and reimbursement for mileage provided for in Section 81 of this\n\ntitle, except as provided for in subsection B of this section.\n\nHowever, if the employee is required by the subpoena to testify in a\n\ncounty other than his county of residence or employment, he shall be\n\nentitled to receive reimbursement pursuant to the State Travel\n\nReimbursement Act in accordance with Section 82 of this title. No\n\nsuch witness shall receive such reimbursement in more than one case\n\ncovering the same period of time or the same travel. Each such\n\nwitness shall be required to make oath that the amounts claimed for\n\nreimbursement have not been claimed or received in any other case or\n\nfrom any other source.\n\nB. It is the intent of the Legislature that court appearances\n\nshould not adversely affect the education of students enrolled in\n\nschool districts in this state. To the extent possible, court\n\nappearances of public school district employees should be scheduled\n\nto minimize the disruption of class time. If a school district\n\nemployee is subpoenaed to appear as a witness in a civil court\n\nproceeding, except in a proceeding in which the school district or\n\nthe state is a party, the school district shall be entitled to a\n\nwitness fee equal to the amount of the substitute teacher cost, not\n\nto exceed One Hundred Dollars ($100.00) per day.","path":["OK Code","Title 28"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os28.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1af26738440932299b3b47183a64ad2fe618a5cfb04ff9146bf341f4c6e6f149","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-28-28-84","next":"us-ok/okla.-stat.-tit.-28-28-85"},"notice":"GroundRules: Original legal text.
