Except as otherwise provided for in this title or in the\n\nOklahoma Farmed Cervidae Act, no person may breed, possess or raise\n\nnative wildlife, except fish, amphibians, aquatic reptiles, aquatic\n\ninvertebrates or exotic livestock, for commercial purposes without\n\nfirst obtaining a commercial wildlife breeder’s license from the\n\nDirector.\n\nB. No person licensed under this section with a commercial\n\nwildlife breeder’s license may sell native cats or bears specified\n\nin subsection E of this section to any person who does not possess a\n\ncommercial wildlife breeder's license.\n\nC. A commercial wildlife breeder’s license may be issued to any\n\nperson whom the Director believes to be acting in good faith, and\n\nwhom the Director believes does not intend to use the license for\n\nthe purpose of violating any of the laws of the State of Oklahoma,\n\nand who proves that the brood stock to be used will be obtained in a\n\nlawful manner.\n\nD. The fee for a commercial wildlife breeder’s license issued\n\nunder this section, and all renewals of the license, shall be Forty-\n\neight Dollars ($48.00). All commercial wildlife breeder’s licenses\n\nissued pursuant to this section shall expire on June 30 of each\n\nyear.\n\nE. Any person who keeps or maintains any native bear or native\n\ncat that will grow to reach the weight of fifty (50) pounds or more\n\nshall be licensed under this section with a commercial wildlife\n\nbreeder’s license. Any person licensed pursuant to this subsection\n\nshall at all times keep such wildlife confined to the premises\n\ndescribed in the commercial wildlife breeder application, and\n\ncontrolled and restrained in a manner so the life, limb or property\n\nof any person lawfully entering the premises shall not be\n\nendangered. Any person licensed to possess native cats or bears\n\npursuant to this subsection shall control and restrain the wildlife\n\nso that there is no direct contact between the public and the\n\nwildlife, and the public shall not be allowed to enter into any\n\nenclosures occupied by the wildlife.\n\nF. 1. Any person who is a nonresident or entity not\n\npermanently located within the state which exhibits native cats or\n\nnative bears that will grow to reach the weight of fifty (50) pounds\n\nor more in this state on a temporary basis shall be required to\n\nobtain from the Director a nonresident cat or bear temporary\n\nexhibitor’s permit. Any person with a permit issued pursuant to\n\nthis paragraph shall be exempt from acquiring a commercial wildlife\n\nbreeder’s license issued under this section and shall be exempt from\n\nthe requirements set forth in subsection E of this section. The fee\n\nfor a nonresident cat or bear temporary exhibitor’s permit shall be\n\nOne Hundred Dollars ($100.00) and shall be valid for thirty (30)\n\ndays. To obtain a nonresident cat or bear temporary exhibitor’s\n\npermit, the person shall be required to hold a valid exhibitor’s\n\nlicense issued by the United States Department of Agriculture.\n\n2. Any resident of the state who has a commercial wildlife\n\nbreeder’s license issued pursuant to this section who wishes to\n\nexhibit native cats or native bears that will grow to reach the\n\nweight of fifty (50) pounds or more at the permanent facility\n\ndescribed in the commercial wildlife breeder’s license or at a\n\ntemporary facility shall be required to obtain from the Director a\n\nresident cat or bear exhibitor’s permit. Any person with a permit\n\nissued pursuant to this paragraph shall be required to also have a\n\ncommercial wildlife breeder’s license issued under this section and\n\nshall comply with the requirements set forth in subsection E of this\n\nsection when not exhibiting the wildlife. The fee for a resident\n\ncat or bear exhibitor’s permit shall be Fifty Dollars ($50.00) and\n\nshall be valid for one (1) year. To obtain a resident cat or bear\n\nexhibitor’s permit the person shall be required to hold a valid\nmercial wildlife breeder’s license issued under this section and\n\nshall comply with the requirements set forth in subsection E of this\n\nsection when not exhibiting the wildlife. The fee for a resident\n\ncat or bear exhibitor’s permit shall be Fifty Dollars ($50.00) and\n\nshall be valid for one (1) year. To obtain a resident cat or bear\n\nexhibitor’s permit the person shall be required to hold a valid\n\nexhibitor’s license issued by the United States Department of\n\nAgriculture.\n\n3. Any person with a permit to exhibit native cats or bears\n\npursuant to paragraph 1 or 2 of this subsection shall at all times\n\nkeep the wildlife controlled and restrained in a manner so the life,\n\nlimb, or property of any person lawfully entering the premises where\n\nthe wildlife is being exhibited shall not be endangered by the\n\nwildlife. Any person with a permit to exhibit native cats or bears\n\npursuant to paragraph 1 or 2 of this subsection shall control and\n\nhandle the wildlife so there is no direct contact between the public\n\nand the wildlife, and the public shall not be allowed to enter into\n\nany enclosures occupied by the wildlife. Any native cat or bear and\n\nany facility covered under a permit issued pursuant to paragraph 1\n\nor 2 of this subsection shall be available for inspection at all\n\nreasonable times by authorized representatives of the Department.\n\nG. Any person convicted of violating the provisions of this\n\nsection shall be punished by a fine of not less than Five Hundred\n\nDollars ($500.00) and, if applicable, shall have the wildlife\n\nlicense of the person revoked.
