Except as otherwise provided in the Oklahoma Wildlife\n\nConservation Code, no person shall fish, pursue, harass, catch,\n\nkill, take in any manner, use, have in possession, sell, or\n\ntransport all or any portion of fish without having first procured a\n\nlicense for such from the Director or from any of the authorized\n\nagents of the Department of Wildlife Conservation. The Oklahoma\n\nWildlife Conservation Commission may designate two (2) days per year\n\nin which residents and nonresidents may fish without first procuring\n\na fishing license pursuant to the provisions of this section.\n\nB. The following legal residents of Oklahoma and the following\n\nnonresidents shall be exempt from the annual fishing license\n\nrequirements of subsection C of this section:\n\n1. Legal residents under eighteen (18) years of age and\n\nnonresidents under eighteen (18) years of age;\n\n2. Legal residents sixty-five (65) years of age or older and\n\nnonresidents sixty-five (65) years of age or older from states which\n\ndo not require nonresident fishing licenses for persons sixty-five\n\n(65) years of age or older, provided a legal resident has obtained a\n\nsenior citizen lifetime fishing or combination hunting and fishing\n\nlicense pursuant to the provisions of Section 4-114 of this title;\n\n3. Legal resident veterans having a disability of sixty percent\n\n(60%) or more and registered with the veterans registry created by\n\nthe Oklahoma Department of Veterans Affairs; provided, that if the\n\nveteran has previously received an exemption pursuant to this\n\nparagraph, no registration with the veterans registry shall be\n\nrequired. The Oklahoma Wildlife Conservation Commission shall\n\npromulgate any rules necessary to implement the provisions of this\n\nparagraph;\n\n4. Legal resident owners or tenants, their spouses, parents,\n\ngrandparents, children and their spouses, grandchildren and their\n\nspouses who fish in private ponds on land owned or leased by them;\n\n5. Any legal resident or nonresident who is a patient of an\n\ninstitution of the State of Oklahoma established for the care and\n\ntreatment of mental illness or alcohol or drug dependency or any\n\ndevelopmentally disabled person residing in any group home or other\n\ninstitution or developmentally disabled persons when accompanied by\n\nan attendant of the institution or legal guardian of the patient, or\n\nwhen fishing on institutional property;\n\n6. Any legal resident or nonresident who is legally blind or\n\nwho has any other physical impairment, as certified by a physician\n\nlicensed in this state or any state which borders this state, which\n\nprevents the person from properly using fishing apparatus without\n\nthe assistance of another person, and any one person actually\n\naccompanying and actually assisting such legally blind or otherwise\n\nphysically impaired person while the latter is fishing. This\n\ncertification shall be carried by the individual while fishing;\n\n7. Any legal resident or nonresident who is a Job Corps trainee\n\nof this state, provided that the trainees shall have on their\n\npersons a duly authorized identification card issued by their\n\nrespective Job Corps Center and shall present the card upon request,\n\nin lieu of a fishing license. The trainees shall return their cards\n\nto their respective Job Corps Center when the trainees leave their\n\nrespective Job Corps training programs;\n\n8. Any legal resident having a proven disability which renders\n\nthe resident nonambulatory and confined to a wheelchair as certified\n\nby a physician licensed in this state or any state which borders\n\nthis state;\n\n9. Any legal resident who is fishing with a pole and line,\n\ntrotline, or throwline in streams, natural lakes, natural ponds, and\n\nmine pits in the county in which the person is a resident, or in\n\nstreams, natural lakes, natural ponds, and mine pits which form a\n\npart of the boundary line of the county in which the person is a\nhysician licensed in this state or any state which borders\n\nthis state;\n\n9. Any legal resident who is fishing with a pole and line,\n\ntrotline, or throwline in streams, natural lakes, natural ponds, and\n\nmine pits in the county in which the person is a resident, or in\n\nstreams, natural lakes, natural ponds, and mine pits which form a\n\npart of the boundary line of the county in which the person is a\n\nresident, when using any bait other than commercial or artificial\n\nbait, blood, stink bait, cut fish, and shrimp; and\n\n10. Any legal resident or nonresident participating in an\n\naquatic education event or clinic sanctioned by the Department of\n\nWildlife Conservation.\n\nC. Except as otherwise provided for in the Oklahoma Wildlife\n\nConservation Code, the fishing licenses issued pursuant to the\n\nprovisions of this section and the fee for each shall be:\n\n1. Annual fishing license for legal residents eighteen (18)\n\nyears of age and older, valid for one (1) year from the date of\n\nissuance - Thirty Dollars ($30.00);\n\n2. Annual fishing license for nonresidents, valid for one (1)\n\nyear from the date of issuance - Eighty Dollars ($80.00), provided\n\nthe Commission may enter into reciprocity agreements with states\n\nwherein nonresident license fees shall be in conformity with such\n\nreciprocal agreements;\n\n3. Daily fishing license for residents – Ten Dollars ($10.00);\n\nand\n\n4. Daily fishing license for nonresidents – Twenty-five Dollars\n\n($25.00).\n\nD. Legal residents who have resided in this state for at least\n\nsix (6) months and who are receiving Social Security Disability\n\nbenefits, Supplemental Security Income benefits, disability benefits\n\nunder the Railroad Retirement Act, 45 U.S.C.A., Section 231a, postal\n\nemployees receiving disability benefits pursuant to 5 U.S.C.,\n\nSection 8451 (1998) or legal residents who are one hundred percent\n\n(100%) disabled and are receiving disability payments from the\n\nMultiple Injury Trust Fund pursuant to Section 31 of Title 85A of\n\nthe Oklahoma Statutes, may purchase a five year disability\n\ncombination hunting/fishing license from the Director for Twenty\n\nDollars ($20.00) for five (5) years.\n\nE. 1. Any person arrested while violating the provisions of\n\nthis section who does not meet the requirements of subsection H of\n\nthis section, may purchase a substitute temporary thirty-day license\n\nfrom the arresting game warden in lieu of posting bond. The fee for\n\na substitute license purchased pursuant to the provisions of this\n\nsubsection shall be:\n\na. for legal residents, One Hundred Dollars ($100.00),\n\nand\n\nb. for nonresidents, One Hundred Fifty Dollars ($150.00).\n\n2. Except as otherwise provided by this subsection, the fees\n\nfrom licenses purchased pursuant to the provisions of this\n\nsubsection shall be deposited in the Wildlife Conservation Fund to\n\nbe used exclusively for developing, managing, preserving, and\n\nprotecting wildlife and wildlife habitat.\n\nF. Unless a substitute license is purchased as provided for by\n\nsubsection E of this section, any resident of this state convicted\n\nof violating the provisions of this section shall be punished by the\n\nimposition of a fine of not less than Twenty-five Dollars ($25.00)\n\nnor more than Two Hundred Dollars ($200.00) or by imprisonment in\n\nthe county jail for a period not to exceed thirty (30) days, or by\n\nboth such fine and imprisonment.\n\nG. Unless a substitute license is purchased as provided for by\n\nsubsection E of this section, any nonresident convicted of violating\n\nthis section shall be punished by a fine of not less than Fifty\n\nDollars ($50.00) nor more than Two Hundred Dollars ($200.00) or by\n\nimprisonment in the county jail for a period not more than thirty\no exceed thirty (30) days, or by\n\nboth such fine and imprisonment.\n\nG. Unless a substitute license is purchased as provided for by\n\nsubsection E of this section, any nonresident convicted of violating\n\nthis section shall be punished by a fine of not less than Fifty\n\nDollars ($50.00) nor more than Two Hundred Dollars ($200.00) or by\n\nimprisonment in the county jail for a period not more than thirty\n\n(30) days, or by both such fine and imprisonment.\n\nH. Any person producing proof in court that a current fishing\n\nlicense issued by the Department of Wildlife Conservation to that\n\nperson was in force at the time of the alleged offense shall be\n\nentitled to dismissal of a charge of violating this section upon\n\npayment of court costs.
