No person may ship or transport minnows for sale into or out\n\nof this state without having first procured a license for such from\n\nthe Director.\n\nB. Commercial minnow export and import:\n\n1. Except as otherwise provided in the Oklahoma Wildlife\n\nConservation Code, no person may harvest, attempt to harvest, assist\n\nin harvesting, sell, or buy for the purpose of exporting minnows\n\nfrom the waters of this state or import into this state, without\n\nhaving first procured the proper license for such purposes from the\n\nDirector. The fees for licenses under this section shall be set by\n\nthe Commission for persons having an established residence in this\n\nstate and who have been currently residing in this state for a\n\nperiod of one (1) year or more prior to the issuance of a license\n\nand for nonresidents;\n\n2. Prior to the issuance of this license, the applicant shall\n\nfile with the Department a surety bond issued by a company licensed\n\nto do business in this state in the sum of One Thousand Dollars\n\n($1,000.00), conditioned upon the observance and compliance with the\n\nprovisions of the Oklahoma Wildlife Conservation Code. This bond\n\nshall be subject to forfeiture upon conviction for the violation of\n\nany of the provisions of the Oklahoma Wildlife Conservation Code or\n\nresolutions of the Department;\n\n3. The Commission shall regulate the harvest season, harvest\n\nlimits, exports limits, size and species to be harvested. The\n\nCommission shall issue such other regulations as it deems necessary\n\nand shall design all forms necessary for the operation of these\n\nprovisions;\n\n4. No minnows shall be harvested except during daylight hours\n\nfrom sunrise to sunset as set by the National Weather Service. The\n\nCommission shall designate the waters of this state where the\n\nharvest of minnows for export purposes shall be permitted;\n\n5. All persons licensed as \"Commercial Minnow Export Dealers\"\n\nshall comply with Sections 6-401 and 6-501 of the Oklahoma Wildlife\n\nConservation Code and with all resolutions of the Commission\n\npertaining to the export of minnows from this state; and\n\n6. Provided, however, any person leaving the state possessing\n\nthree (3) dozen or fewer minnows or any person selling or shipping\n\nminnows raised in a regularly licensed commercial minnow hatchery\n\nshall be exempt from the licensing provisions of this section.\n\nC.
