Except for owners and operators of farmed or commercial\n\ncervidae facilities licensed pursuant to the Oklahoma Farmed\n\nCervidae Act, no person, including but not limited to persons\n\nlicensed for commercial hunting or wildlife breeders, may hunt,\n\nchase, capture, shoot, shoot at, wound, attempt to take or take,\n\nattempt to kill or kill, or slaughter an antelope, moose, whitetail\n\nor mule deer, bear, elk, mountain lion, Rocky Mountain bighorn\n\nsheep, wild turkey, or any subspecies except in open season under\n\nSection 5-401 of this title.\n\n2. Unless legally harvested from a commercial hunting area, no\n\nperson shall sell, offer for sale or buy or offer to buy an\n\nantelope, moose, whitetail or mule deer, bear, elk, mountain lion,\n\nrocky mountain bighorn sheep, wild turkey, or any subspecies or any\n\nparts thereof, except as provided by:\n\na. rules prescribed by the Wildlife Conservation\n\nCommission,\n\nb. any federal laws or regulations, or\n\nc. the Oklahoma Farmed Cervidae Act.\n\n3. The provisions of this subsection shall not be construed to\n\nprevent a hide, antlers or horns from a legally taken whitetail or\n\nmule deer, elk, moose, antelope or Rocky Mountain bighorn sheep from\n\nbeing sold or traded by a person who legally harvested or who\n\nlegally possesses the hide, antlers or horns, including a person who\n\nhas obtained legal possession of the hide, antlers, or horns after\n\nbeing given to the person for taxidermic preparation. Except as\n\notherwise provided, any antlers or horns sold or traded pursuant to\n\nthis subsection shall have been removed from the skull of the animal\n\nin such a way as to leave no portion of the skull attached. The\n\nowner or operator of a farmed or commercial cervidae facility may\n\nsell or trade the antlers or horns of a farmed or commercial\n\ncervidae with the skull attached as provided for in the Oklahoma\n\nFarmed Cervidae Act. Upon request, the Director of Wildlife\n\nConservation may grant an exemption from the restrictions of this\n\nparagraph to allow a person who has legally harvested or who is in\n\nlegal possession of the antlers or horns from a legally taken animal\n\nto sell or trade the antler or horns with the skull attached.\n\nB. 1. It shall be unlawful for any person to have in their\n\npossession any meat, head, hide or any part of the carcass of any\n\nwildlife not legally taken.\n\n2. Any meat, head, hide or any part of the carcass of any\n\nwildlife not legally taken shall be subject to immediate seizure by\n\na game warden.\n\n3. The provisions of this subsection shall not apply to\n\nprivately owned domesticated animals designated by the Wildlife\n\nConservation Commission or farmed cervidae facilities licensed\n\npursuant to the Oklahoma Farmed Cervidae Act.\n\nC. Persons excepted from the provisions of this section are:\n\n1. Department employees when in the performance of their\n\nduties; and\n\n2.
