No person may net, trap or seine for commercial purposes or\n\nassist in such operations or buy, barter or trade any fish without\n\nhaving first obtained a valid commercial fishing license and without\n\nobserving the following requirements:\n\n1. No nets, traps, seines and other similar devices shall be\n\nused closer than one hundred (100) yards from the shore.\n\n2. Except as otherwise provided, no type of set or unattended\n\nequipment or gear may have a mesh size of less than three (3) inches\n\nsquare nor shall such be set within four (4) feet of the surface of\n\nthe water. Exceptions may be provided by the Department:\n\na. under specific contracts with the Department.\n\nb. under experimental netting operations conducted by\n\nDepartment employees or under strict supervision of\n\ndepartmental personnel.\n\nc. for operations conducted for the specific commercial\n\ncollection of shad and turtles, the Department may\n\nliberalize the type of gear, mesh size and activities\n\nof this type of operation. Such liberalization shall\n\nbe approved by the Commission.\n\n3. All types of set or unattended equipment shall have\n\nidentification tags, as prescribed by the Department, attached while\n\nsuch equipment is set or unattended in the waters of this state.\n\n4. All commercial fishing operations shall be done under the\n\nsupervision of a game warden or other regular employee of the\n\nDepartment.\n\n5. No commercial fishermen may possess, have in their\n\npossession at their places of business or transport any species of\n\ngame fish or any striped bass hybrid.\n\n6. All licensees shall send to the Department a true monthly\n\nand annual summary of all fish captured and captured and returned to\n\nthe waters of the state.\n\n7. Any other regulations the Commission decides by resolution.\n\nB. Any equipment used in violation of this section may be\n\nconfiscated and disposed of according to the law.\n\nC. Any person convicted of violating the provisions of this\n\nsection shall be punished by a fine not less than One Hundred\n\nDollars ($100.00) nor more than Five Hundred Dollars ($500.00), or\n\nby imprisonment in the county jail for a period not to exceed thirty\n\n(30) days, or by both such fine and imprisonment. Any conviction of\n\nviolating the provisions of this section shall prevent licensee from\n\nobtaining for a period of one (1) year any subsequent commercial\n\nfishing or helper's license or a commercial fishing contract.\n\nConviction of violating any of the provisions of this section shall\n\nrequire mandatory forfeiture of any nets, traps, seines, or similar\n\ndevices used during said prohibited act.
