Except as otherwise provided by subsection B of this\n\nsection, no person may net or trap aquatic turtles for commercial\n\npurposes or assist in such operations or buy, barter, trade or\n\nexport any aquatic turtles from this state without having first\n\nobtained a valid commercial turtle harvester's license and without\n\nobserving the following requirements:\n\n1. All types of traps shall have an identification tag with the\n\nowner's name and license number attached and the name and license\n\nnumber of all persons authorized to operate the traps or nets;\n\n2. Aquatic turtles may be harvested for commercial purposes\n\nonly from private ponds, with permission of the pond owner and from\n\nmunicipal lakes, with written permission of the municipal authority;\n\n3. Traps and nets must be cleaned and emptied at least once\n\nevery forty-eight (48) hours;\n\n4. Any game or nongame fish trapped or netted during a turtle\n\nharvesting operation shall be immediately released to the water; and\n\n5. Legally taken nongame fish and their parts may be utilized\n\nfor bait in turtle harvesting operations.\n\nB. No person may take for commercial purposes by any means, or\n\nassist in any such operations, turtles or aquatic turtles from any\n\nscenic river area of this state as such areas are designated\n\npursuant to Section 1452 of Title 82 of the Oklahoma Statutes or\n\nfrom any major river channel specifically designated by rule by the\n\nOklahoma Wildlife Conservation Commission to be restricted from\n\ncommercial turtle or aquatic turtle harvesting.\n\nC. The Commission may promulgate other rules it deems necessary\n\nto implement the provisions of this section.\n\nD. Any equipment used in violation of this section shall be\n\nconfiscated and become the property of the Department or disposed of\n\naccording to law.\n\nE. Any person convicted of violating the provisions of this\n\nsection shall be punished by a fine of not less than One Hundred\n\nDollars ($100.00) nor more than Five Hundred Dollars ($500.00) or by\n\nimprisonment in the county jail for a period not to exceed thirty\n\n(30) days or by both such fine and imprisonment.","path":["OK Code","Title 29"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os29.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c17ca342c27c1e72ea6c050d8ea48e30f2c1d5bf92120cfecc108a581d5c1de8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-29-29-6-203","next":"us-ok/okla.-stat.-tit.-29-29-6-301"},"notice":"GroundRules: Original legal text.
