Stat. tit. 29, § 29-6-301a","heading":"Prohibited means of taking game or nongame fish -","body":"Poison, explosive, or electrical shock devices.\n\nA. No person may use at any time in the waters of this state\n\nfor taking, catching, capturing or killing any game or nongame fish\n\nany of the following instrumentalities:\n\n1. Any rotenone or other poison;\n\n2. Dynamite or other explosive; or\n\n3. Any electrical device used for shocking purpose.\n\nB. Possession of any poison, explosive, device or equipment\n\ncapable of being used in violation of the provisions of this\n\nsection, on the bank or in the immediate vicinity of any river,\n\ncreek, stream, lake or pond shall be prima facie evidence of a\n\nviolation of the provisions of this section.\n\nC. Any explosive, device or equipment, and any boat, motor or\n\nboat and motor in which the same may be found shall be subject to\n\nimmediate seizure by any game warden, sheriff or deputy sheriff and\n\nany such items shall be subject to forfeiture pursuant to the\n\nprovisions of the Oklahoma Wildlife Conservation Code to the State\n\nof Oklahoma in a proceeding brought for such purpose in the county\n\nwhere such items have been found or seized.\n\nD. No person may manufacture, sell, or offer to sell or buy or\n\noffer to buy any electrical device designed to shock fish or used\n\nfor the purpose of shocking fish except when such device is\n\nrequested by a state or federal agency for scientific fisheries\n\nwork.\n\nE. Any person convicted of violating the provisions of this\n\nsection shall be punished by a fine of not less than Five Hundred\n\nDollars ($500.00) nor more than One Thousand Dollars ($1,000.00), or\n\nby imprisonment in the county jail for a period not to exceed thirty\n\n(30) days, or by both such fine and imprisonment. Any person, upon\n\nconviction of a second or subsequent violation of this section when\n\nsaid violation occurred within two (2) years of a previous\n\nconviction for violating said provisions, shall be punished by a\n\nfine of not less than Five Hundred Dollars ($500.00) nor more than\n\nOne Thousand Dollars ($1,000.00) or by imprisonment in the county\n\njail for a period not to exceed ninety (90) days, or by both such\n\nfine and imprisonment. In addition, all fishing licenses and\n\nfishing privileges within the state of such person shall be revoked\n\nfor a period of one (1) year from the date of such conviction.\n\nF. Persons exempt from the prohibitions of this section shall\n\nbe:\n\n1. The Director, department employees or authorized agents\n\npursuant to their duties; and\n\n2.
