No person may take, kill, or catch or attempt to take, kill,\n\nor catch any nongame fish from the waters of this state or assist in\n\nany such endeavor in any manner except as follows:\n\n1. By all legal hook and line methods in state waters legally\n\nopen to these methods; and\n\n2. By nets or seines used to take nongame fish only in such\n\nwaters as are declared open to such nets or seines by the\n\nCommission. Such nets or seines shall:\n\na. be hoop nets with a mesh size no smaller than three-\n\ninch square mesh, or gill nets, trammel nets, or\n\nseines with a mesh size no smaller than four-inch\n\nsquare mesh, and\n\nb. have the name and address of the owner attached\n\nthereto if the net is to be left unattended, and\n\nc. be attended once every twenty-four (24) hours.\n\nEach license holder shall be limited to a maximum of three\n\nhundred (300) feet of net or a total of four hoop nets in the water\n\nat any time.\n\nNo fish taken pursuant to this noncommercial netting provision\n\ncan be sold or transported from the state.\n\nNoncommercial netting shall be prohibited statewide during April\n\nand May annually; and\n\n3. By arrows, gigs, ropes, grab hooks, spears, and spearguns\n\nused by divers equipped with self-contained underwater breathing\n\napparatus. Such gigs or spears may have no more than three points\n\nwith not more than two barbs on each point; and\n\n4. By noodling; and\n\n5. By cast nets and handheld dip nets used to take only nongame\n\nfish as bait for personal use in all waters of the state except\n\nthose closed by the Commission. The cast nets shall have a mesh\n\nsize no greater than three-eighths-inch square mesh; and\n\n6. By trawl nets pulled by motor-driven boats. Such nets may\n\nbe used to take only nongame fish as bait for personal use in all\n\nwaters of the state except those closed by the Commission. Trawl\n\nnets may not exceed three (3) feet in diameter with no greater than\n\nthree-eighths-inch square mesh.\n\nB. The Commission shall have authority to designate by\n\nregulation areas, waters of this state, or parts thereof for the\n\ntaking, catching, or killing of nongame fish by noodling or by the\n\nuse of arrows, gigs, cast nets, dip nets, spears, ropes, grab hooks,\n\nand spearguns used by divers equipped with self-contained underwater\n\nbreathing apparatus, and to also designate the times such may be\n\nused.\n\nC. 1. Except as otherwise provided in this subsection, any\n\nperson convicted of violating the provisions of this section shall\n\nbe punished by the imposition of a fine not less than One Hundred\n\nDollars ($100.00).\n\n2. Any person convicted of violating the provisions of this\n\nsection by netting, snaglining or selling nongame fish shall be\n\npunished by imposition of a fine of not less than One Hundred\n\nDollars ($100.00), or by imprisonment in the county jail for a\n\nperiod not to exceed thirty (30) days, or by both such fine and\n\nimprisonment. Any person, upon conviction of a second or subsequent\n\nviolation of the provisions of this section by netting, snaglining\n\nor selling nongame fish when said violation occurred within two (2)\n\nyears of a previous conviction for violating said provisions, shall\n\nbe punished by imposition of a fine of not less than Five Hundred\n\nDollars ($500.00) nor more than One Thousand Dollars ($1,000.00), or\n\nby imprisonment in the county jail for a period not to exceed ninety\n\n(90) days, or by both such fine and imprisonment. In addition, all\n\nfishing licenses and all fishing privileges within the state of such\n\nperson shall be revoked for a period of one (1) year from the date\n\nof such conviction.\n\nD.
