Except as otherwise provided, no person shall possess:\n\n1. The eggs of more than one paddlefish that are still attached\n\nto the egg membrane; or\n\n2. More than three (3) pounds combined of processed paddlefish\n\neggs or fresh paddlefish eggs that have been removed from the egg\n\nmembrane.\n\nB. Except as otherwise provided, no person shall ship into or\n\nout of, transport into or out of, have in possession with the intent\n\nto so transport, or cause to be removed from this state raw\n\nunprocessed, processed, or frozen paddlefish eggs. No person shall\n\ntransport paddlefish with viscera out of the state.\n\nC. The provisions of this section shall not apply to:\n\n1. The Director of the Department of Wildlife Conservation,\n\nemployees of the Department of Wildlife Conservation or authorized\n\nagents of the Department who are acting pursuant to their duties;\n\n2. Any paddlefish products which are derived from lawfully\n\npropagated fish licensed under rules promulgated by the Wildlife\n\nConservation Commission;\n\n3. Any paddlefish products to which the Director has given an\n\nindividual specific written authority to transport the product into\n\nor out of the state; and\n\n4. Any processed and packaged paddlefish products imported into\n\nthe state if accompanied by an invoice stating the point of\n\norigination of the paddlefish product.\n\nD. Any person convicted of violating the provisions of this\n\nsection shall be punished by the imposition of a fine of not less\n\nthan One Thousand Dollars ($1,000.00) nor more than Ten Thousand\n\nDollars ($10,000.00) for the first offense and not less than Two\n\nThousand Dollars ($2,000.00) nor more than Twenty-five Thousand\n\nDollars ($25,000.00) for a second offense, or by imprisonment in the\n\ncounty jail for a period not to exceed one (1) year, or by\n\nconfiscation of any equipment used in violation of this section\n\npursuant to the provisions of Section 7-206 of this title, or by a\n\ncombination of fine, imprisonment and confiscation.\n\nE. In addition to other penalties provided for in this section,\n\nany person convicted of taking, possessing or transporting, or\n\nacting as an accessory in taking, possessing or transporting\n\nprocessed or unprocessed paddlefish products with a current market\n\nvalue exceeding Five Thousand Dollars ($5,000.00) shall upon\n\nconviction be guilty of a misdemeanor punishable by a fine of not\n\nless than Five Thousand Dollars ($5,000.00) nor more than Twenty-\n\nfive Thousand Dollars ($25,000.00), or by imprisonment in the county\n\njail for a period not to exceed one (1) year, or by both such fine\n\nand imprisonment. In addition to the fine and imprisonment provided\n\nfor in this subsection, any item, equipment, vehicle or other\n\nproperty which is used or operated in violation of this section\n\nshall be seized and may be sold pursuant to the provisions of\n\nSection 7-206 of this title. The proceeds of the sale of any item,\n\nequipment, vehicle or property that is distributed to the Department\n\nof Wildlife Conservation shall be used by the Department to combat\n\nthe unlawful taking and possession of paddlefish in this state.\n\nF.
