Except as otherwise provided, no person may fish upon the\n\nland of another without the consent of the owner, lessee or occupant\n\nof such land.\n\nB. For purposes of this section, consent shall be presumed to\n\nbe valid for not more than one (1) year, unless the owner, lessee,\n\nor occupant specifically grants consent for a specified period of\n\ntime.\n\nC. Excluding land primarily devoted to farming, ranching, or\n\nforestry purposes as set forth in Section 1835.2 of Title 21 of the\n\nOklahoma Statutes, areas exempt from the above provision are:\n\n1. Lands not occupied by a resident thereon, unless notice of\n\nobjection is conspicuously posted upon the premises by the owner or\n\nan agent of the owner; and\n\n2. Land of the state which is not leased and occupied by a\n\nresident, excluding school land.\n\nD. Any ranger investigating a fisherman in the field has a duty\n\nto inform the fisherman that it is necessary to obtain the\n\nlandowner's or occupier's consent to fish on the particular property\n\nprovided that prosecution for violations of this section can be\n\ncommenced only upon written complaint of such owner or occupant\n\nfiled before any court authorized to punish such violation, or upon\n\nwritten complaint to any game ranger, or officer authorized to make\n\narrest for such offenses.\n\nE. Trespassing on lands which are fenced and exhibit posted\n\nsigns at all entrances is hereby prohibited. Trespassing on land\n\nprimarily devoted to farming, ranching, or forestry purposes as set\n\nforth in Section 1835.2 of Title 21 of the Oklahoma Statutes is\n\nhereby prohibited. Hunters and fishermen in violation of this\n\nprovision of this Code shall be subject to fines as outlined in\n\nsubsection F of this section.\n\nF. Any person convicted of violating provisions of this section\n\nshall be responsible for any actual damages incurred and shall be\n\npunished by a fine of not less than Fifty Dollars ($50.00) nor more\n\nthan Five Hundred Dollars ($500.00), or by imprisonment in the\n\ncounty jail for thirty (30) days, or by both such fine and\n\nimprisonment for a first violation of this section. Persons\n\nconvicted of a second or subsequent violation of this section shall\n\nbe deemed guilty of a misdemeanor and shall be responsible for any\n\nactual damages incurred and shall be fined not less than Five\n\nHundred Dollars ($500.00) nor more than One Thousand Dollars\n\n($1,000.00), or by confinement in the county jail for not less than\n\nthirty (30) days nor more than six (6) months, or by both such fine\n\nand imprisonment.","path":["OK Code","Title 29"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os29.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"82f0131a91cbca165df61018a9a88eb9ad7de16dc761de7537401f7cd3b0a80d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-29-29-6-303.1","next":"us-ok/okla.-stat.-tit.-29-29-6-305"},"notice":"GroundRules: Original legal text.
