Except as otherwise provided in this section, no person may\n\ndeposit, place, throw, or permit to be deposited, placed or thrown,\n\nany lime, dynamite or other explosive, poison, drug, sawdust, salt\n\nwater, crude oil or any other deleterious, noxious or toxic\n\nsubstance in any waters of this state, or in any place where such\n\nsubstances may run or be washed into such waters.\n\nB. Those persons exempt from subsection A of this section shall\n\nbe:\n\n1. The Department's authorized agents and employees when they\n\nshall use drugs, chemicals and other substances in connection with\n\nany fish count, scientific test or for improvement; and\n\n2. Those holders of a scientific purposes license which\n\nspecifically authorizes taking wildlife in such manner.\n\nC. Any person, firm or corporation violating the provisions of\n\nthis section shall be punished by a fine of not less than One\n\nHundred Dollars ($100.00) nor more than Five Hundred Dollars\n\n($500.00), and each day or part of day during which such action is\n\ncontinued or repeated shall be a separate offense. Provided, that\n\nthe party responsible for the control of any salt water, crude oil\n\nor other deleterious substances causing a violation of this section\n\nand resulting from drilling, production, transmission, storage or\n\nother operation of the petroleum industry shall be reported to the\n\nOklahoma Corporation Commission and if corrective action is not\n\ntaken immediately then criminal proceedings shall be had as herein\n\nprovided. The Corporation Commission is also given the express\n\npower to order whatever corrective action is necessary to abate the\n\npollution and is given the authority to enforce the order by any\n\naction against the lease or well.
