Stat. tit. 3, § 3-103","heading":"Power to adopt airport zoning regulations - Joint boards","body":"(1) In order to prevent the creation or establishment of\n\nairport hazards, every political subdivision having an airport\n\nhazard area within its territorial limits shall adopt, administer,\n\nand enforce, under the police power and in the manner and upon the\n\nconditions hereinafter prescribed, airport zoning regulations for\n\nsuch airport hazard area, which regulations may divide such area\n\ninto zones, and within such zones, specify the land uses permitted\n\nand regulate and restrict the height to which structures and trees\n\nmay be erected or allowed to grow.\n\n(2) Where an airport is owned or controlled by a political\n\nsubdivision and any airport hazard area appertaining to such airport\n\nis located outside the territorial limits of the political\n\nsubdivision, the political subdivision owning or controlling the\n\nairport and the political subdivision within which the airport\n\nhazard area is located may, by ordinance or resolution duly adopted,\n\ncreate a Joint Airport Zoning Board, which Board shall have the same\n\npower to adopt, administer and enforce airport zoning regulations\n\napplicable to the airport hazard area in question as that vested by\n\nsubsection (1) of this section in the political subdivision within\n\nwhich such area is located. Each Joint Board shall have as members\n\ntwo representatives appointed by each political subdivision\n\nparticipating in its creation and in addition a chairman elected by\n\na majority of the members so appointed. The chairman shall be\n\nelected from the appointed membership of the Board for a term of two\n\n(2) years.\n\n(3) Where the airport hazard area appertaining to any airport\n\nis located within the territorial limits of two or more political\n\nsubdivisions, such political subdivisions together with the\n\npolitical subdivision, if any, owning or controlling said airport\n\nmay, by ordinance or resolution duly adopted, create a Joint Zoning\n\nBoard, which Board shall have the same power to adopt, administer\n\nand enforce airport zoning regulations applicable to the airport\n\nhazard area in question as that vested by subsection (1) of this\n\nsection in the political subdivision within which such area is\n\nlocated. Each such Joint Board shall have as members one member\n\nappointed by each political subdivision participating in its\n\ncreation and an additional member appointed by each political\n\nsubdivision having a total population in excess of thirty-six\n\nthousand (36,000). The chairman shall be elected by a majority of\n\nthe members so appointed. The chairman shall be elected from the\n\nappointed membership of the Board for a term of two (2) years. The\n\nJoint Board shall have the power to make its own rules governing its\n\nmeetings and procedure and any zoning regulation shall be effective\n\nupon adoption by a majority of its members and shall thereupon be\n\nfiled with the county clerk, without charge, of each county in which\n\nthe airport hazard area is located. The resolution shall then be\n\npresented for adoption to each of the political subdivisions\n\nparticipating in the Joint Airport Zoning Board. The failure of a\n\npolitical subdivision to participate in the creation of the Joint\n\nAirport Zoning Board shall not restrict the authority of the Joint\n\nAirport Zoning Board to make and enforce zoning regulations over the\n\nentire airport hazard area.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e4627935ba08312bf50d2ee4d1357f3906d14ae379a1b5f3298db71d83feece8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-102.2","next":"us-ok/okla.-stat.-tit.-3-3-104"},"notice":"GroundRules: Original legal text.
