Stat. tit. 3, § 3-108","heading":"Appeals","body":"\n\n(1) Any person aggrieved, or taxpayer affected, by any decision\n\nof an administrative agency made in its administration of airport\n\nzoning regulations adopted under this act, or any governing body of\n\na political subdivision, or any Joint Airport Zoning Board, who is\n\nof the opinion that a decision of such an administrative agency is\n\nan improper application of airport zoning regulations of such\n\ngoverning body or board, may appeal to the Board of Adjustment\n\nauthorized to hear and decide appeals from the decisions of such\n\nadministrative agency.\n\n(2) All appeals taken under this section must be taken within a\n\nreasonable time, as provided by the rules of the Board of\n\nAdjustment, by filing with the agency from which the appeal is taken\n\nand with the Board, a notice of appeal specifying the grounds\n\nthereof. The agency from which the appeal is taken shall forthwith\n\ntransmit to the Board all the papers constituting the record upon\n\nwhich the action appealed from was taken.\n\n(3) An appeal shall stay all proceedings in furtherance of the\n\naction appealed, unless the agency from which the appeal is taken\n\ncertifies to the Board, after the notice of appeal has been filed\n\nwith it, that by reason of the facts stated in the certificate a\n\nstay would, in its opinion, cause imminent peril to life or\n\nproperty. In such cases proceedings shall not be stayed otherwise\n\nthan by order of the Board on notice to the agency from which the\n\nappeal is taken and on due cause shown.\n\n(4) The Board shall fix a reasonable time for the hearing of\n\nappeals, give public notice and due notice to the parties in\n\ninterest including the Commission, and decide the same within a\n\nreasonable time. Upon the hearing any party may appear in person or\n\nby agent or by attorney.\n\n(5) The Board may, in conformity with the provisions of this\n\nact, reverse or affirm wholly or partly, or modify, the order,\n\nrequirement, decision, or determination appealed from and may make\n\nsuch order, requirement, decision or determination as ought to be\n\nmade, and to that end shall have all the powers of the\n\nadministrative agency from which the appeal is taken.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a6ecb3591a5cac5e4c16fbdf3fb4c7f66047046846ed967babbca63ea41dc776","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-107","next":"us-ok/okla.-stat.-tit.-3-3-109"},"notice":"GroundRules: Original legal text.
