A person shall obtain a permit from the Commission prior to\n\nthe construction, installation, or use of any of the following near\n\na public-use airport:\n\n1. Any proposed structure or area for an incompatible purpose\n\nin the primary surface or the runway protection zone;\n\n2. Any structure, alteration or addition to a structure within\n\nthree (3) statute miles from the airport reference point of a\n\npublic-use airport, that would result in a total structure height in\n\nexcess of one hundred fifty (150) feet above the established airport\n\nelevation; and\n\n3. Any structure, alteration or addition to a structure that\n\nwould result in a total structure height greater than the\n\nhorizontal, conical or approach surfaces, as defined in Section\n\n120.2 of this title.\n\nB. No permit shall be required:\n\n1. For mobile or temporary equipment used to construct or\n\ninstall a new structure or to perform routine maintenance, repairs,\n\nor replace parts of an existing structure or for temporary\n\nstructures that will be in place for less than twenty-four (24)\n\nmonths; or\n\n2. To repair, replace, or alter an existing structure that\n\nwould not result in a total structure height greater than the\n\nhorizontal, conical or approach surfaces as defined in Section 120.2\n\nof this title, or change the location of an existing structure.\n\nC. Any person required to notify the FAA of any proposed\n\nconstruction or alteration pursuant to Subpart B of Section 77.13 of\n\nthe Federal Aviation Regulations Part 77, that in response receives\n\nan acknowledgement from the FAA that further aeronautical study is\n\nrequired to determine whether the proposed construction or\n\nalteration would be a hazard to air navigation, shall, upon\n\nrequesting further aeronautical study by the FAA, concurrently\n\nnotify the Commission of the request and shall provide the\n\nCommission with true and correct copies of all relevant filings made\n\nwith the FAA.\n\nUpon receipt of such notification of the filing of a request for\n\nfurther aeronautical study, the Commission shall give timely notice\n\nthereof to the Oklahoma Strategic Military Planning Commission, or\n\nany successor agency, and to any military airport within Oklahoma\n\npotentially affected by the proposed construction or alteration.\n\nThe Commission further shall use its best efforts to establish\n\nregular and consistent communication with the FAA to encourage\n\nsharing of information regarding construction or alteration in a\n\nmilitary training route or slow-speed low-altitude training route\n\nwithin the State of Oklahoma with appropriate state agencies and\n\nmilitary installations.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2f6227669649a9201b3d9a9f6982e0362309937ae597295f74dd9a6092da6c4e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-120.2","next":"us-ok/okla.-stat.-tit.-3-3-120.4"},"notice":"GroundRules: Original legal text.
