If FAA Form 7460-1 is required, then an application for a\n\npermit pursuant to Section 120.3 of this title shall be filed at the\n\nsame time the FAA Form 7460-1 is sent to the FAA, or at any time\n\nbefore that. If FAA Form 7460-1 is not required, then the\n\napplication shall be filed at least thirty (30) days before the\n\nearlier of the following:\n\n1. The date the proposed construction or alteration is to\n\nbegin; or\n\n2. The date an application for a construction or building\n\npermit is to be filed with the municipality.\n\nUpon receiving an application, the Commission shall notify a legal\n\nrepresentative of the public-use airport owner affected by the\n\napplication and solicit comments from the airport owner.\n\nB. In determining whether to issue a permit, the Commission\n\nshall consider:\n\n1. The nature of the terrain and height of existing structures;\n\n2. Public and private interests and investments of an airport;\n\n3. The character of flying operations and planned developments\n\nof an airport;\n\n4. Whether the construction of the proposed structure would\n\ncause an increase in the minimum descent altitude or the decision\n\nheight at the affected airport;\n\n5. Technological advances;\n\n6. The safety of persons on the ground and in the air;\n\n7. Land use density;\n\n8. Comments from all interested persons; and\n\n9. Findings and determinations of other government agencies.\n\nC. If FAA Form 7460-1 is required, then the Commission shall\n\nnotify the applicant of its determination within thirty (30) days of\n\nthe FAA completing its aeronautical study. If the applicant has not\n\nbeen notified by the Commission of its determination within thirty\n\n(30) days of the FAA completing its aeronautical study, then the\n\napplicant shall notify the Commission that it has not received\n\nnotice of the Commission's determination. The Commission shall then\n\nhave seven (7) working days from the date of the applicant's notice\n\nto notify the applicant of its determination. Nothing herein\n\nprecludes the Commission from making its determination before the\n\nFAA completes its aeronautical study.\n\nD. If FAA Form 7460-1 is not required, then the Commission\n\nshall notify the applicant of its determination within sixty (60)\n\ndays of filing the application. If the applicant has not been\n\nnotified by the Commission of its determination within sixty (60)\n\ndays of filing the application, then the applicant shall notify the\n\nCommission that it has not received notice of the Commission's\n\ndetermination.
