Stat. tit. 3, § 3-120.8","heading":"Application process after issuance of permit - Amending a","body":"permit.\n\nA. Once a permit is issued by the Commission, the applicant\n\nshall be required to complete the following steps to complete the\n\npermit process:\n\n1. The applicant for a permit under Section 120.3 of this title\n\nshall record each permit issued by the Commission in the office of\n\nthe county clerk for the county where the structure is located not\n\nlater than sixty (60) business days after the Commission issues the\n\npermit. If a structure is located in more than one county, the\n\ncounty that contains the majority of the structure is the county in\n\nwhich the permit must be filed. A permit issued under paragraph 1\n\nof subsection A of Section 120.3 of this title shall contain the\n\nfollowing statement:\n\n\"The permittee acknowledges for itself, its heirs, its\n\nsuccessors, and its assigns, that the real estate\n\ndescribed in this permit is located within the primary\n\nsurface or the runway protection zone of a public-use\n\nairport, and that the permittee is building a structure\n\nupon this real estate with the full knowledge and\n\nacceptance that it may be incompatible with normal\n\nairport operations including the landing and takeoff of\n\naircraft.\";\n\n2. A permit issued in accordance with the provisions of Section\n\n120.3 of this title is valid only after the Commission receives a\n\ncertified copy of the recorded permit with the recording data from\n\nthe county clerk of the county in which the structure is located;\n\nand\n\n3. Every permit granted by the Commission shall specify that\n\nobstruction markers, markings, lighting, or other visual or aural\n\nidentification required to be installed on or in the vicinity of the\n\nstructure shall conform to federal laws and regulations.\n\nB. Once a permit is valid the permittee may request to amend a\n\npermit under these conditions:\n\n1. The amendment is to change the administrative items of the\n\npermit including the transfer of ownership rights. There shall be\n\nno limit to the number of times a permittee can request an amendment\n\nthat is administrative in nature; or\n\n2. The amendment is for the purpose of micrositing a structure\n\nthat has been permitted, but not yet constructed. Micrositing shall\n\nallow for a structure to be moved four hundred (400) feet or less in\n\na horizontal direction provided the new location will not impact an\n\nairport's instrument or visual approaches. A permittee can request\n\nto amend a permit for micrositing up to two times.
