For purposes of this section:\n\n1. “Anemometer” means an instrument for measuring and recording\n\nwind speed;\n\n2. “Anemometer tower” means a structure, including all guy\n\nwires and accessory facilities, on which an anemometer is mounted,\n\nthat is fifty (50) feet in height above the ground or higher, is not\n\nlocated within the boundaries of a municipality, and whose\n\nappearance is not otherwise regulated by state or federal law;\n\n3. “Commission” means the seven members of the Oklahoma\n\nAerospace and Aeronautics Commission; and\n\n4. “Department” means the Oklahoma Department of Aerospace and\n\nAeronautics.\n\nB. In addition to any zoning requirements of the Airport Zoning\n\nAct or the Aircraft Pilot and Passenger Protection Act, the\n\nDepartment shall promulgate rules regulating the appearance of\n\nanemometer towers to ensure that anemometer towers are clearly\n\nrecognizable in clear air during daylight hours according to the\n\nfollowing guidelines:\n\n1. The Department shall consider the best method for making\n\nanemometer towers visible, including but not limited to painting,\n\nflagging, or marking the towers and guy wires; and\n\n2. Any rule promulgated pursuant to this section may apply\n\nimmediately, upon adoption, to anemometer towers constructed after\n\nthe date of adoption; however, anemometer towers constructed prior\n\nto the date of adoption of the rule shall be exempt from the rule\n\nfor one (1) year from the date of adoption.\n\nC. The Department shall establish and maintain a database\n\ncontaining the location of all anemometer towers by November 1,\n\n2015. The Department may contract with a governmental entity or\n\nprivate entity to create and maintain the database.\n\nD. The Department shall promulgate rules requiring an owner of\n\nan anemometer tower to provide the Department with information\n\nspecifying the location and height of the tower, and any other\n\ninformation the Department may require to ensure aviation safety.\n\nE. The Department shall promulgate rules requiring any person\n\nproposing to construct an anemometer tower to notify the Department\n\nof such proposal. The Department shall require the owner of the\n\nproposed tower to provide the Department with information specifying\n\nthe location and height of the tower, and any other information the\n\nDepartment may require to ensure aviation safety.\n\nF. The Department shall promulgate rules by requiring the owner\n\nof an anemometer tower to notify the Department upon removal or\n\ndestruction of an anemometer tower.\n\nG. The Department shall have the authority to promulgate rules\n\nand implement administrative penalties to enforce the provisions of\n\nthis section.\n\nH.
