Stat. tit. 3, § 3-322","heading":"Critical infrastructure facility – Unmanned aircraft","body":"prohibited.\n\nA. As used in this section:\n\n1. \"Critical infrastructure facility\" means:\n\na. one of the following, if completely enclosed by a\n\nfence or other physical barrier that is obviously\n\ndesigned to exclude intruders, or if clearly marked\n\nwith a sign or signs that are posted on the property,\n\nare reasonably likely to come to the attention of\n\nintruders, and indicate that entry is forbidden or\n\nflight of unmanned aircraft without site authorization\n\nis forbidden:\n\n(1) a petroleum or alumina refinery,\n\n(2) an electrical power generating facility,\n\nsubstation, switching station or electrical\n\ncontrol center,\n\n(3) a chemical, polymer or rubber manufacturing\n\nfacility,\n\n(4) a water intake structure, water treatment\n\nfacility, wastewater treatment plant or pump\n\nstation,\n\n(5) a natural gas compressor station,\n\n(6) a liquid natural gas terminal or storage\n\nfacility,\n\n(7) a telecommunications central switching office,\n\n(8) wireless telecommunications infrastructure,\n\nincluding cell towers,\n\n(9) a port, railroad switching yard, trucking\n\nterminal or other freight transportation\n\nfacility,\n\n(10) a gas processing plant, including a plant used in\n\nthe processing, treatment or fractionation of\n\nnatural gas or natural gas liquids,\n\n(11) a transmission facility used by a federally\n\nlicensed radio or television station,\n\n(12) a steelmaking facility that uses an electric arc\n\nfurnace to make steel,\n\n(13) a facility identified and regulated by the United\n\nStates Department of Homeland Security Chemical\n\nFacility Anti-Terrorism Standards (CFATS)\n\nprogram,\n\n(14) a dam that is regulated by the state or federal\n\ngovernment, or\n\n(15) a natural gas distribution utility facility,\n\nincluding, but not limited to, pipeline\n\ninterconnections, a city gate or town border\n\nstation, metering station, aboveground piping, a\n\nregulator station and a natural gas storage\n\nfacility, or\n\nb. any aboveground portion of an oil, gas, hazardous\n\nliquid or chemical pipeline that is enclosed by a\n\nfence or other physical barrier that is obviously\n\ndesigned to exclude intruders;\n\n2. \"Dam\" means any barrier, including any appurtenant\n\nstructures, that is constructed for the purpose of permanently or\n\ntemporarily impounding water; and\n\n3. \"Unmanned aircraft\" means an aircraft without occupants that\n\nis flown by a pilot via a ground control system or autonomously\n\nthrough use of an onboard computer and other additional equipment\n\nnecessary to operate the aircraft and includes unmanned aircraft\n\ncommonly called drones.\n\nB. Except as provided in subsection C of this section, a person\n\nshall not intentionally or knowingly:\n\n1. Operate an unmanned aircraft over a critical infrastructure\n\nfacility if the unmanned aircraft is less than four hundred (400)\n\nfeet above ground level;\n\n2. Allow an unmanned aircraft to make contact with a critical\n\ninfrastructure facility, including any person or object on the\n\npremises of or within the facility; or\n\n3. Allow an unmanned aircraft to come within a distance of a\n\ncritical infrastructure facility that is close enough to interfere\n\nwith the operations of or cause a disturbance to the facility.\n\nC. This section shall not apply to conduct committed by:\n\n1. The federal government, the state or a political subdivision\n\nof the state;\n\n2. A person under contract with or otherwise acting under the\n\ndirection or on behalf of the federal government, the state or a\n\npolitical subdivision of the state;\n\n3. A law enforcement agency;\n\n4. A person under contract with or otherwise acting under the\n\ndirection or on behalf of a law enforcement agency;\n\n5. An owner or operator of the critical infrastructure\n\nfacility;\n\n6. A person under contract with or otherwise acting under the\n\ndirection or on behalf of an owner or operator of the critical\n\ninfrastructure facility;\n\n7. A person who has the prior written consent of the owner or\n;\n\n4. A person under contract with or otherwise acting under the\n\ndirection or on behalf of a law enforcement agency;\n\n5. An owner or operator of the critical infrastructure\n\nfacility;\n\n6. A person under contract with or otherwise acting under the\n\ndirection or on behalf of an owner or operator of the critical\n\ninfrastructure facility;\n\n7. A person who has the prior written consent of the owner or\n\noperator of the critical infrastructure facility;\n\n8. The owner or occupant of the property on which the critical\n\ninfrastructure facility is located or a person who has the prior\n\nwritten consent of the owner or occupant of that property; or\n\n9. An operator of an unmanned aircraft that is being used for a\n\ncommercial purpose, if the operator is authorized by the Federal\n\nAviation Administration to conduct operations over that airspace.\n\nD.
