Except as provided in subsection B of this section, a space\n\nflight entity shall not be held liable for a participant injury\n\nresulting from the risks of space flight activities, provided that\n\nthe participant has been informed of the risks of space flight\n\nactivities as required by federal law and the Space Flight Liability\n\nand Immunity Act, and the participant has given informed consent\n\nthat the participant is voluntarily participating in space flight\n\nactivities after having been informed of the risks of those\n\nactivities as required by federal law and the Space Flight Liability\n\nand Immunity Act. Except as provided in subsection B of this\n\nsection, no:\n\n1. Participant;\n\n2. Participant's representative, including the heirs,\n\nadministrators, executors, assignees, next of kin, and estate of the\n\nparticipant; or\n\n3. Person who attempts to bring a claim on behalf of the\n\nparticipant for a participant injury,\n\nis authorized to maintain an action against or recover from a space\n\nflight entity for a participant injury that results from the risks\n\nof space flight activities.\n\nB. Nothing in subsection A of this section shall prevent or\n\nlimit the liability of a space flight entity if the space flight\n\nentity:\n\n1. Commits an act or omission that constitutes gross negligence\n\nevidencing willful or wanton disregard for the safety of the\n\nparticipant, and that act or omission proximately causes a\n\nparticipant injury; or\n\n2. Intentionally causes a participant injury.\n\nC.
