There is hereby created within the Oklahoma Department of\n\nAerospace and Aeronautics, the Oklahoma Air Service Development\n\nGrant Program. The Oklahoma Air Service Development Grant Program\n\n(OASDGP) is designed to offer financial assistance by grant to\n\nprivate or public entities for the purpose of assisting commercial\n\nair service development. Grant funding is administered based on\n\nmerit and the potential for a specific project to enhance the\n\nstate’s economy. Grants are one-time awards.\n\nB. Grant funding can be used for commercial air service\n\ndevelopment projects and include minimum revenue guarantees for\n\nspecific new routes, marketing and advertising of service, market\n\nstudy and research projects to develop data for a business case for\n\nnew service, start-up cost offsets to reduce the cost of an airline\n\nbeginning service, and other innovative risk sharing models to\n\nsupport the introduction of new airline service in the state.\n\nGrants must be used to recruit service in an airport-pair that has\n\nno current, daily scheduled airline service. Grants may not be used\n\nto support current routes or to recruit a second carrier to an\n\nairport-pair.\n\nC. Public, private and nonprofit entities within this state\n\nthat have sufficient financial and management capacity to complete\n\nthe requested project are eligible for funding under this program.\n\nEligible entities include:\n\n1. Airport sponsors of publicly owned airports;\n\n2. Oklahoma municipalities;\n\n3. Chambers of commerce; or\n\n4. Community organizations that promote economic development.\n\nD. Each application must include a detailed business plan with\n\nsupporting data for the proposed project. The business plan should\n\ninclude:\n\n1. Available passengers for the route including local demand\n\nand connecting demand;\n\n2. Detail on available revenue;\n\n3. Current and historical fare data relative to peers and how\n\nthe project will lower fares; and\n\n4. Business demand for companies based in this state or doing\n\nbusiness in this state that may use the proposed route.\n\nE. Projects with airline support will be considered first for\n\nfunding under this program. Airline support can be evidenced by a\n\nletter, dated, signed, and on airline letterhead, or other\n\ncommunication directly from an airline stating its support for the\n\nfunding and its interest in the proposed route. An airline letter\n\nof support is not required for funding to be allocated to a project\n\nbut will be used in prioritizing fund awards.\n\nF. To be considered for state funding under this program,\n\napplicants must demonstrate the ability to provide a minimum twenty\n\npercent (20%) of all funding for the project through local sources.\n\nLocal funding should be dedicated to the project and evidenced by\n\nletters of commitment before an application is submitted. Any\n\nprivate enterprise or nonairport, nonmunicipal, nonprofit entity\n\nmust have a letter of credit to qualify for a grant without a public\n\npartner.\n\nG. Each application should include a narrative organized into\n\nseven (7) sections:\n\n1. A proposal summary;\n\n2. Applicant organization description, history, and ability to\n\nfund the project;\n\n3. Air service background and history of the airport/market;\n\n4. Project description, target route, and specific business\n\nplan for service;\n\n5. Timeline;\n\n6. Budget including local funding; and\n\n7. Letters of support.\n\nH. Applications will first be vetted for completeness. Any\n\napplication which does not include the information listed in\n\nsubsection G will be eliminated from consideration. Any application\n\nthat does not include local funding for at least twenty percent\n\n(20%) of the project cost will be eliminated from consideration.\n\nAny applicant that cannot demonstrate he or she is working with an\n\nairport sponsor on the project will be eliminated from\n\nconsideration.\napplication which does not include the information listed in\n\nsubsection G will be eliminated from consideration. Any application\n\nthat does not include local funding for at least twenty percent\n\n(20%) of the project cost will be eliminated from consideration.\n\nAny applicant that cannot demonstrate he or she is working with an\n\nairport sponsor on the project will be eliminated from\n\nconsideration.\n\nI. Once applications have been deemed to meet minimum\n\nrequirements, they will be evaluated for funding against each other,\n\nwith special attention paid to the following criteria in this order:\n\n1. The viability of the business case for service and the\n\nopportunity for service to be sustainable;\n\n2. The need for the service in the community and region;\n\n3. The challenges with current air service that could be\n\nrectified with grant funding;\n\n4. Share of local funding versus grant funding;\n\n5. Airline support for the project;\n\n6. Broad-based stakeholder support for the project; and\n\n7. The ability to use the funding in a timely manner.\n\nThe Oklahoma Department of Commerce shall be part of this review\n\nprocess. The state may request additional information from the\n\napplicant and may require a written response from the applicant for\n\nany outstanding questions. The state reserves the right to require\n\nformal presentations from each applicant to explain the proposed\n\nproject.\n\nJ. The state will enter into a grant agreement contract with\n\nrecipients prior to distributing program funds. The agreement shall\n\ninclude:\n\n1. The specific project receiving grant funding;\n\n2. The maximum dollar amount of state funding;\n\n3. Effective dates of the grant;\n\n4. Rights to terminate the grant agreement;\n\n5. Inspection and reporting requirements to verify project\n\nstatus and expenditures; and\n\n6. Conditions of disbursement of grant funds including\n\nobligation to repay funds if the terms of the agreement are not met.\n\nThe grant agreement contract shall require the awardee to\n\nprovide ongoing quarterly reports stating progress and detailing any\n\nactivity related to the project.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8cb191f9ff3a135dc11f1519576af5dadad5e7b5308aca8c53183115fd713aa1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-412","next":"us-ok/okla.-stat.-tit.-3-3-414"},"notice":"GroundRules: Original legal text.
