Stat. tit. 3, § 3-521","heading":"Acquisition of property by purchase or condemnation —","body":"Compensation.\n\nA. The Oklahoma Space Industry Development Authority is hereby\n\nauthorized and empowered to acquire by purchase, or condemnation,\n\nreal property and such interest therein as may be necessary in its\n\ndetermination for the purpose of establishing, constructing,\n\nmaintaining, or operating a spaceport and spaceport facilities, upon\n\nsuch terms and at such price as may be considered by the Authority\n\nto be reasonable and can be agreed upon between the Authority and\n\nthe owner of the land. The Authority shall take title to the\n\nproperty in its name; provided, however, such right and title shall\n\nbe limited to the surface rights only and shall not include oil or\n\nother mineral rights.\n\nB. 1. The Authority shall not acquire through the power of\n\ncondemnation a total area of real property for purposes of\n\nestablishing a spaceport in excess of twenty-five (25) acres. The\n\ntotal acreage acquired by the Authority pursuant to the power of\n\ncondemnation shall be specifically identified in the records of the\n\nAuthority and the Authority shall maintain a separate record of such\n\nacreage open to public inspection. If the Authority attempts to\n\nacquire an area through the power of condemnation that would exceed\n\nthe acreage limit provided by this subsection, the proceeding for\n\nsuch acquisition shall be subject to an order for a temporary\n\ninjunction which may be issued ex parte. Upon an adequate showing\n\nof proof, the Authority shall be permanently enjoined from acquiring\n\nreal property pursuant to its powers of condemnation if the\n\nacquisition would exceed the maximum acreage authorized by this\n\nsubsection.\n\n2. Except in instances where there are nonresident owners,\n\nunknown heirs, imperfect titles, and owners whose whereabouts cannot\n\nbe ascertained with reasonable diligence, the Oklahoma Space\n\nIndustry Development Authority shall give the owner an opportunity\n\nto sell the necessary real property or interests therein to the\n\nAuthority before exercising the power of condemnation.\n\n3. In cases where the Authority exercises the power of\n\ncondemnation, the Authority shall be governed by the provisions of\n\nSection 1708 of Title 69 of the Oklahoma Statutes.\n\nC. The Authority shall pay compensation to the owners of any\n\nand all real property located wholly or partially within the area\n\nrequired to be evacuated for the launch of any vehicle from\n\nspaceport territory for the economic value of the lost value of the\n\nbeneficial use of such property as a result of requirements imposed\n\nby the Authority pursuant to its powers for the establishment,\n\nmaintenance and safe operation of a spaceport or spaceport facility.\n\nCompensation for such economic value shall be made according to the\n\nrequirements of Section 24 of Article 2 of the Constitution of the\n\nState of Oklahoma.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a22f9990dcf66dccd4f45c238a83a7e9ae5204aed45b69d2911c7747000edddc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-520","next":"us-ok/okla.-stat.-tit.-3-3-522"},"notice":"GroundRules: Original legal text.
