Stat. tit. 3, § 3-527","heading":"Exclusive jurisdiction and power within spaceport territory","body":"— Limitations on power.\n\nA. 1. Except as provided in subsection B of this section,\n\nconsistent with the laws of this state, and any other laws of this\n\nstate to the contrary notwithstanding, the jurisdiction and powers\n\nof the Board of Directors of the Oklahoma Space Industry Development\n\nAuthority within the spaceport territory with respect to the matters\n\nprovided for in this act pertaining to the operation, maintenance,\n\nand safety of the spaceport shall be exclusive of any and all codes,\n\nordinances, requirements, plans or other regulations of the boards\n\nof county commissioners or of any other agency or authority of any\n\ncounty or municipality in this state. All land, properties and\n\nactivities within any spaceport territory pertaining to the\n\noperation, maintenance, and safety of the spaceport, shall be exempt\n\nfrom any and all such codes, ordinances, requirements, plans and\n\nregulations, and any and all requirements for building and\n\nconstruction permits and licenses pertaining to the same,\n\npromulgated by the boards of county commissioners of any county or\n\ncity councils of any municipality in the state; provided, however,\n\nnothing herein shall exempt any general contractor, electrical\n\ncontractor, builder, owner-builder or specialty contractor from the\n\nprovisions and requirements of any laws of this state, with respect\n\nto examination and licensing, or from any of the fees and bonds\n\nrequired of such contractors or builders by law.\n\n2. The Board may by appropriate rule provide that any spaceport\n\nterritory, or such areas or parts thereof pertaining to the\n\noperation, maintenance, and safety of the spaceport, as the Board\n\nmay designate from time to time, shall, for such time or times as\n\nthe Board may determine, remain or become subject to such county or\n\nmunicipal zoning, building and safety codes and regulations, and\n\nregulations and controls with respect to subdivisions and plats and\n\nthe vacating thereof, or any of them, as the Board may determine.\n\n3. The jurisdiction and powers of the Board provided for herein\n\nshall within the spaceport territory also be exclusive of any law\n\nnow or hereafter enacted providing for land use regulation, zoning\n\nor building codes by this state or any agency or authority of the\n\nstate, and the provisions of any such law shall not be applicable\n\nwithin the territorial limits of any spaceport territory.\n\n4. The Board may exercise the powers granted to it in this\n\nsubsection within the city limits of any municipality now or\n\nhereafter organized or existing within the limits of any spaceport\n\nterritory.\n\nB. The Authority may not exercise any of its powers as provided\n\nfor in this section in a manner that prohibits:\n\n1. The agricultural use of land that is located within a\n\nspaceport territory and is not acquired by the Authority under the\n\nprovisions of Section 5210 of this title;\n\n2. Continued access to water for such land for agricultural\n\npurposes; and\n\n3. The erection of outbuildings and personal residences on such\n\nland, subject to population density restrictions prescribed by the\n\nAuthority to comply with federal requirements for licensure as a\n\nspaceport; provided, erection of personal residences shall not\n\ninclude subdivision of land for the purpose of constructing and\n\nselling houses.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"baa8c1412b979c8d82e07d2f5d4aaac31d3ae6143d14f5b3be1467b9c331f1b0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-526","next":"us-ok/okla.-stat.-tit.-3-3-528"},"notice":"GroundRules: Original legal text.
