Except as provided in subsection B of this section, for the\n\npurposes of operating, maintaining, and providing for the safety of\n\na spaceport the Board of Directors of the Oklahoma Space Industry\n\nDevelopment Authority shall have the power within any spaceport\n\nterritory to:\n\n1. Adopt, and from time to time review, amend, supplement or\n\nrepeal, a comprehensive general plan for the physical development of\n\nthe area within any spaceport territory in accordance with the\n\nobjectives and purposes of this act;\n\n2. Adopt, and from time to time review, amend, supplement or\n\nrepeal, codes regulating the following matter within any spaceport\n\nterritory: building safety, elevators, escalators and similar\n\ndevices, the prevention of fire hazards, plumbing and electrical\n\ninstallations, the operation and development of missile ranges,\n\nlaunch pads, payload procession and assembly facilities, the\n\noperation of amusement and recreation installations, parks and\n\nfacilities, water supply wells and drainage wells, and such other\n\nsafety or sanitary codes as the Board may determine to be necessary\n\nor desirable;\n\n3. Prohibit within any spaceport territory the construction,\n\nalteration, repair, removal or demolition, or the commencement of\n\nthe construction, alteration, repair except for emergency repairs,\n\nremoval or demolition, of any building or structure, including but\n\nnot limited to, public utility poles, lines, pipes and facilities,\n\nwithout first obtaining a permit from the Board or such other\n\nofficer or agency as the Board may designate, and to prescribe the\n\nprocedure with respect to the obtaining of such permit; and\n\n4. Provide for the manner in which such comprehensive general\n\nplans, codes, regulations and restrictions shall be determined,\n\nestablished and enforced, and from time to time amended,\n\nsupplemented, charged or repealed within the spaceport territory, as\n\nthe Board may determine.\n\nB. The Authority may not exercise any of its powers as provided\n\nfor in this section in a manner that prohibits:\n\n1. The agricultural use of land that is located within a\n\nspaceport territory and is not acquired by the Authority under the\n\nprovisions of Section 5210 of this title;\n\n2. Continued access to water for such land for agricultural\n\npurposes; and\n\n3. The erection of outbuildings and personal residences on such\n\nland, subject to population density restrictions prescribed by the\n\nAuthority to comply with federal requirements for licensure as a\n\nspaceport; provided, erection of personal residences shall not\n\ninclude subdivision of land for the purpose of constructing and\n\nselling houses.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e6eb4aa834f7f6c824128024a7b7c9bcd45d3387a2610a78b74eea3ce7aac184","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-527","next":"us-ok/okla.-stat.-tit.-3-3-529"},"notice":"GroundRules: Original legal text.
