Except as provided in subsection B of this section, in\n\naddition to other powers granted by the Oklahoma Space Industry\n\nDevelopment Act, for the purposes of operating, maintaining, and\n\nproviding for the safety of a spaceport the Board of Directors shall\n\nhave the power within any spaceport territory to:\n\n1. Regulate, restrict and determine the location, height,\n\nnumber of stories, size, cubic contents, area and design, and the\n\nerection, construction, reconstruction, alteration and repair of\n\nbuildings and other structures for space industry development,\n\ntrade, industry, commerce, residence and other purposes, and the\n\nmaterials used in the construction thereof; the number, location,\n\nheight, size, appearance and use of billboards and all other\n\nadvertising signs, banners, handbills and devices; the percentage\n\nand portion of lots and land that may be occupied or built on;\n\nsetback lines; the density of population; the use of buildings,\n\nstructures, land and water for trade, industries, commerce, and\n\nresidences and any and all other purposes; the location, size and\n\nplan of spaceport facilities, launch pads, ranges, payload assembly\n\nand processing facilities, parks and recreational areas, commercial\n\nand industrial facilities, public and private utilities, traffic,\n\nparking facilities and drainage and water control facilities; and to\n\nappoint inspectors;\n\n2. Adopt rules to prohibit or control the pollution of air and\n\nwater, and to require certain location and placement of electrical\n\npower, telephone and other utility lines, cables, pipes, and ducts;\n\nand\n\n3. Divide any spaceport territory into zones or districts of\n\nsuch number, shape and area as the Board may deem best suited to\n\ncarry out the purposes of the Oklahoma Space Industry Development\n\nAct, and within and for each such district adopt rules and\n\nrestrictions as provided for in this section.\n\nB. The Authority may not exercise any of its powers as provided\n\nfor in this section in a manner that prohibits:\n\n1. The agricultural use of land that is located within a\n\nspaceport territory and is not acquired by the Authority under the\n\nprovisions of Section 5210 of this title;\n\n2. Continued access to water for such land for agricultural\n\npurposes; and\n\n3. The erection of outbuildings and personal residences on such\n\nland, subject to population density restrictions prescribed by the\n\nAuthority to comply with federal requirements for licensure as a\n\nspaceport; provided, erection of personal residences shall not\n\ninclude subdivision of land for the purpose of constructing and\n\nselling houses.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e2591fc512cdfe7f5f7b50bac946ac047478341f403e08d63d79daf835525c78","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-528","next":"us-ok/okla.-stat.-tit.-3-3-530"},"notice":"GroundRules: Original legal text.
