For the purposes of this section, unless\n\notherwise qualified, the term “public agency” includes municipality,\n\nas defined in the Municipal Airports Act, an agency of the state\n\ngovernment and of the United States, and any municipality, political\n\nsubdivision and agency of another state, but shall not include\n\ninstitutions of higher education constituting the Oklahoma State\n\nSystem of Higher Education under Section 1, Article 13A,\n\nConstitution of the State of Oklahoma; or other institutions\n\ncoordinated with the State System of Higher Education under Section\n\n4, Article 13A, Constitution of the State of Oklahoma; and the term\n\n“governing body” means the governing body of a county or\n\nmunicipality, and the head of the agency if the public agency is\n\nother than a county or municipality. All powers, privileges and\n\nauthority granted to any municipality by this act may be exercised\n\nand enjoyed jointly with any public agency of this state, and\n\njointly with any public agency of any other state or of the United\n\nStates to the extent that the laws of such other state or of the\n\nUnited States permit such joint exercise or enjoyment. If not\n\notherwise authorized by law, any agency of the state government when\n\nacting jointly with any municipality, may exercise and enjoy all of\n\nthe powers, privileges and authority conferred by this act upon a\n\nmunicipality.\n\nB. Agreement. Any two or more public agencies may enter into\n\nagreements with each other for joint action pursuant to the\n\nprovisions of this section. Concurrent action by ordinance,\n\nresolution or otherwise or the governing bodies of the participating\n\npublic agencies shall constitute joint action. Each such agreement\n\nshall specify its duration, the proportionate interest which each\n\npublic agency shall have in the property, facilities and privileges\n\ninvolved, the proportion to be borne by each public agency of\n\npreliminary costs and costs of acquisition, establishment,\n\nconstruction, enlargement, improvement, and equipment of the\n\nairport, vertiport, or air navigation facility, the proportion of\n\nthe expenses of maintenance, operation, regulation and protection\n\nthereof to be borne by each, and such other terms as are required by\n\nthe provisions of this section. The agreement may also provide for;\n\namendments thereof, and conditions and methods of termination of the\n\nagreement; the disposal of all or any of the property, facilities\n\nand privileges jointly owned upon said property, facilities and\n\nprivileges, or any part thereof, ceasing to be used for the purposes\n\nprovided by this act, or upon termination of the agreement; the\n\ndistribution of the proceeds received upon any such disposal, and of\n\nany funds or other property jointly owned and undisposed of; the\n\nassumption or payment of any indebtedness arising from the joint\n\nventure which remains unpaid upon the disposal of all assets or upon\n\na termination of the agreement; and such other provisions as may be\n\nnecessary or convenient.\n\nC. Joint Board. Public agencies acting jointly pursuant to\n\nthis section shall create a joint board which shall consist of\n\nmembers appointed by the governing board of each participating\n\npublic agency. The number to be appointed, their term and\n\ncompensation, if any, shall be provided for in the joint agreement.\n\nEach such joint board shall organize, select officers for terms to\n\nbe fixed by the agreement, and adopt and amend from time to time\n\nrules for its own procedure. The joint board shall have power to\n\nplan, acquire, establish, develop, construct, enlarge, improve,\n\nmaintain, equip, operate, regulate, protect, and police any airport,\n\nvertiport, air navigation facility, or airport hazard to be jointly\n\nacquired, controlled and operated, and such board may exercise on\n\nbehalf of its constituent public agencies all the powers of each\n\nwith respect to such airport, vertiport, air navigation facility, or\nacquire, establish, develop, construct, enlarge, improve,\n\nmaintain, equip, operate, regulate, protect, and police any airport,\n\nvertiport, air navigation facility, or airport hazard to be jointly\n\nacquired, controlled and operated, and such board may exercise on\n\nbehalf of its constituent public agencies all the powers of each\n\nwith respect to such airport, vertiport, air navigation facility, or\n\nairport hazard, subject to the limitations of subsection D of this\n\nsection.\n\nD. Limitations on Joint Board.\n\n1. Expenditures. The total expenditures to be made by the\n\njoint board for any purpose in any fiscal year shall be determined\n\nby a budget approved by the governing bodies of its constituent\n\npublic agencies.\n\n2. Acquisitions Beyond Sums Allotted. No airport, vertiport,\n\nair navigation facility, airport hazard, or real or personal\n\nproperty, the cost of which is in excess of sums therefor fixed by\n\nthe joint agreement or allotted in the annual budget, may be\n\nacquired by the joint board without the approval of the governing\n\nbodies of its constituent public agencies.\n\n3. Eminent Domain. Eminent domain proceedings under this\n\nsection may be instituted only by authority of the governing bodies\n\nof the constituent public agencies of the joint board. If so\n\nauthorized, such proceedings shall be instituted in the names of the\n\nconstituent public agencies jointly, and the property so acquired\n\nshall be held by said public agencies as tenants in common until\n\nconveyed by them to the joint board.\n\n4. Disposal of Real Property. The joint board shall not\n\ndispose of any airport, vertiport, air navigation facility, or real\n\nproperty under its jurisdiction except with the consent of the\n\ngoverning bodies of its constituent public agencies, provided that\n\nthe joint board may, without such consent, enter into contracts,\n\nleases, or other arrangements contemplated by Section 65.5 of this\n\ntitle.\n\n5. Police Regulations. Any resolutions, rules, regulations or\n\norders of the joint board dealing with subjects authorized by\n\nSection 65.8 of this title shall become effective only upon approval\n\nof the governing bodies of the constituent public agencies provided\n\nthat upon such approval, the resolutions, rules, regulations or\n\norders of the joint board shall have the same force and effect in\n\nthe territories or jurisdictions involved as the ordinances,\n\nresolutions, rules, regulations, or orders of each public agency\n\nwould have in its own territory or jurisdiction.\n\nE. Joint Fund. For the purpose of providing a joint board with\n\nmoneys for the necessary expenditures in carrying out the provisions\n\nof this section, a joint fund shall be created and maintained, into\n\nwhich shall be deposited the share of each of the constituent public\n\nagencies as provided by the joint agreement. Each of the\n\nconstituent public agencies shall provide its share of the fund from\n\nsources available to each. Any federal, state or other\n\ncontributions or loans, and the revenues obtained from the joint\n\nownership, control and operation of any airport or air navigation\n\nfacility under the jurisdiction of the joint board shall be paid\n\ninto the joint fund, which said joint fund shall be kept and\n\nmaintained at such place or places as shall be mutually agreed\n\nbetween the constituent agencies.
