There is hereby created the Oklahoma Aerospace and\n\nAeronautics Commission, which shall be the successor to the Oklahoma\n\nAviation Commission created by Section 81 et seq. of this title.\n\nThe Oklahoma Aerospace and Aeronautics Commission shall consist of\n\nnine (9) members, seven of whom shall be appointed by the Governor,\n\none of whom shall be appointed by the President Pro Tempore of the\n\nSenate, and one of whom shall be appointed by the Speaker of the\n\nHouse of Representatives. The members shall be appointed for terms\n\nof six (6) years in the same manner as the members originally\n\nappointed under Section 81 et seq. of this title, except that any\n\nperson appointed to fill a vacancy shall be appointed only for the\n\nremainder of such term. Each member shall serve until the\n\nappointment and qualification of a successor. One member shall be\n\nappointed from each congressional district and any remaining members\n\nshall be appointed from the state at large. However, when\n\ncongressional districts are redrawn, each member appointed prior to\n\nJuly 1 of the year in which such modification becomes effective\n\nshall complete the current term of office and appointments made\n\nafter July 1 of the year in which such modification becomes\n\neffective shall be based on the redrawn districts. Appointments\n\nmade after July 1 of the year in which such modification becomes\n\neffective shall be from any redrawn districts which are not\n\nrepresented by a board member until such time as each of the\n\nmodified congressional districts are represented by a board member.\n\nNo appointments may be made after July 1 of the year in which such\n\nmodification becomes effective if such appointment would result in\n\nmore than two members serving from the same modified district. To\n\nqualify for appointment to the Commission, an appointee shall be a\n\ncitizen and bona fide resident of the state. The seven (7) members\n\nappointed by the Governor shall have at least three (3) years’\n\nexperience in aeronautical activities, such as general aviation,\n\nagricultural aviation, airport management, or air carrier operation.\n\nThe two members appointed by the President Pro Tempore of the Senate\n\nand the Speaker of the House of Representatives shall have at least\n\nthree (3) years’ experience in the commercial space industry, a\n\nstate or federal space agency, or administration.\n\nMembers of the Commission shall receive no salary but shall be\n\nentitled to be reimbursed for necessary travel expenses pursuant to\n\nthe State Travel Reimbursement Act. The members of the Commission\n\nmay be removed by the Governor for inefficiency, neglect of duty, or\n\nmalfeasance in office in the manner provided by law for the removal\n\nof officers not subject to impeachment.\n\nB. 1. The Director of the Oklahoma Department of Aerospace and\n\nAeronautics shall be appointed by the Commission, and shall serve at\n\nthe pleasure of the Commission. The Director shall be appointed\n\nwith due regard to such person’s fitness, by aeronautical education\n\nand by knowledge of and recent practical experience in aeronautics\n\nfor the efficient dispatch of the powers and duties duly vested in\n\nand imposed upon the Director. The Director shall devote full time\n\nto the duties of the office and shall not be actively engaged or\n\nemployed in any other business, vocation, or employment, nor shall\n\nthe Director have any pecuniary interest in or any stock in or bonds\n\nof any civil aeronautics enterprise. The Director shall be\n\nreimbursed for all traveling and other expenses incurred in the\n\ndischarge of the official duties of the Director, subject to general\n\nstatutory limitations on such expenses as contained in the State\n\nTravel Reimbursement Act.\n\n2. The Director shall be the executive officer of the\n\nDepartment and under its supervision shall administer the provisions\n\nof Section 81 et seq. of this title and rules, regulations, and\nll traveling and other expenses incurred in the\n\ndischarge of the official duties of the Director, subject to general\n\nstatutory limitations on such expenses as contained in the State\n\nTravel Reimbursement Act.\n\n2. The Director shall be the executive officer of the\n\nDepartment and under its supervision shall administer the provisions\n\nof Section 81 et seq. of this title and rules, regulations, and\n\norders established thereunder and all other laws of the state\n\nrelative to aeronautics. The Director shall attend all meetings of\n\nthe Commission, but shall have no vote. The Director shall be in\n\ncharge of the offices of the Department and responsible for the\n\npreparation of reports and the collection and dissemination of data\n\nand other public information relating to aerospace and aeronautics.\n\nThe Director is hereby empowered to execute all contracts entered\n\ninto by the Commission.\n\n3. The Commission may, by written order filed in its office,\n\ndelegate to the Director any of the powers or duties vested in or\n\nimposed upon it by Section 81 et seq. of this title. Such delegated\n\npowers and duties may be exercised by the Director in the name of\n\nthe Commission.\n\n4. The Director shall appoint, subject to the approval of the\n\nCommission, such experts, field and office assistants, clerks, and\n\nother employees as may be required and authorized for the proper\n\ndischarge of the functions of the Department.\n\nC. The Commission shall, within thirty (30) days after its\n\nappointment, organize, adopt a seal, and make such rules and\n\nregulations for its administration, not inconsistent herewith, nor\n\ninconsistent with, or contrary to, any act of the United States\n\nCongress or regulations promulgated or standards established\n\npursuant thereto, as it may deem expedient and from time to time\n\namend such rules and regulations. At such organizational meeting it\n\nshall elect from among its members a chair, a vice chair, and a\n\nsecretary, to serve for one (1) year, and annually thereafter shall\n\nelect such officers, all to serve until their successors are\n\nappointed and qualified. The Commission shall schedule meetings at\n\na convenient time and place as they become necessary. Five (5)\n\nmembers shall constitute a quorum, and no action shall be taken by\n\nless than a majority of the Commission. Special meetings may be\n\ncalled as provided by the rules and regulations of the Commission.\n\nRegular meetings shall be held at the established offices of the\n\nDepartment, but, whenever the convenience of the public or of the\n\nparties may be promoted, or delay or expense may be prevented, the\n\nCommission may hold meetings, hearings, or proceedings at any other\n\nplace designated by it. The Department shall report in writing to\n\nthe Governor on or about January 31 of each year. The report shall\n\ncontain a summary of the proceedings of the Department during the\n\npreceding fiscal year, a detailed and itemized statement of all\n\nrevenue and of all expenditures made by or on behalf of the\n\nDepartment, such other information as it may deem necessary or\n\nuseful, and any additional information which may be requested by the\n\nGovernor.\n\nD. Suitable office space shall be provided by the Office of\n\nManagement and Enterprise Services for the Department in the City of\n\nOklahoma City, and the Department may incur the necessary expenses\n\nfor office rent, furniture, stationery, printing, incidental\n\nexpenses, and other necessary expenses needed for the administration\n\nof Section 81 et seq. of this title.","path":["OK Code","Title 3"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os3.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ba7ebc18f497aa3e304978d83d8a6c5f2a5e8cee99f453a676d2851418299c23","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-3-3-83","next":"us-ok/okla.-stat.-tit.-3-3-84.2"},"notice":"GroundRules: Original legal text.
