Beginning July 1, 2002, the Oklahoma Department of Aerospace\n\nand Aeronautics shall cease to be part of or a division of the\n\nDepartment of Transportation and shall be deemed to be a separate\n\nand distinct agency, to be known as the Oklahoma Department of\n\nAerospace and Aeronautics, and not under the Merit System of\n\nPersonnel Administration. The Oklahoma Department of Aerospace and\n\nAeronautics and the Director of the Oklahoma Department of Aerospace\n\nand Aeronautics shall continue to exercise their statutory powers,\n\nduties, and responsibilities. All records, property, equipment,\n\nassets, monies, matters pending, and funds of the division shall be\n\ntransferred to the Oklahoma Department of Aerospace and Aeronautics.\n\nB. 1. The number of full-time-equivalent employees for the\n\nOklahoma Department of Aerospace and Aeronautics shall not be less\n\nthan ten, nor more than the number of employees currently allowed by\n\nlaw for the Oklahoma Aeronautics Commission division of the\n\nDepartment of Transportation and who transfer to the Oklahoma\n\nDepartment of Aerospace and Aeronautics pursuant to this section.\n\nIn no event shall the total full-time-equivalent employees of the\n\nOklahoma Department of Aerospace and Aeronautics transferring or\n\nelecting to remain with the Department of Transportation exceed\n\neighteen full-time-equivalent positions.\n\n2. All full-time-equivalent employee positions for the Oklahoma\n\nDepartment of Aerospace and Aeronautics shall not be under the Merit\n\nSystem of Personnel Administration and shall be considered\n\nunclassified service. All employees shall serve at the pleasure of\n\nthe Director of the Oklahoma Department of Aerospace and\n\nAeronautics.\n\n3. The Oklahoma Department of Aerospace and Aeronautics and the\n\nDepartment of Transportation may enter into an agreement for the\n\ntransfer of personnel from the Department of Transportation to the\n\nOklahoma Department of Aerospace and Aeronautics. No employee shall\n\nbe transferred to the Oklahoma Department of Aerospace and\n\nAeronautics except on the freely given written consent of the\n\nemployee. All classified employees under the Merit System of\n\nPersonnel Administration who are not transferred to the Oklahoma\n\nDepartment of Aerospace and Aeronautics shall retain the status in\n\nthe class to which the position occupied by the employee on July 1,\n\n2002, is allocated by the Office of Personnel Management. The\n\nsalary of such an employee shall not be reduced as a result of such\n\nposition allocation. All employees who are transferred to the\n\nOklahoma Department of Aerospace and Aeronautics shall not be\n\nrequired to accept a lesser grade or salary than presently received.\n\nAll employees shall retain leave, sick and annual time earned, and\n\nany retirement and longevity benefits which have accrued during\n\ntheir tenure with the Department of Transportation. The transfer of\n\npersonnel between the state agencies shall be coordinated with the\n\nOffice of Personnel Management.\n\nC. The Oklahoma Department of Aerospace and Aeronautics shall\n\nbe authorized to rent, lease, or own the appropriate office space\n\nand property in order to conduct its business. The Oklahoma\n\nDepartment of Aerospace and Aeronautics is authorized to accept\n\ngifts, bequests, devises, contributions, and grants, public or\n\nprivate, including federal funds or funds from any other source for\n\nuse in furthering the purpose of the Oklahoma Department of\n\nAerospace and Aeronautics.\n\nD. Funding for the Oklahoma Department of Aerospace and\n\nAeronautics shall be provided for in the appropriation process of\n\nthe Legislature, in addition to any other funding provided by law.\n\nThe expenses incurred by the Oklahoma Department of Aerospace and\n\nAeronautics as a result of the transfer required by this section\n\nshall be paid by the Oklahoma Department of Aerospace and\n\nAeronautics.\ns.\n\nD. Funding for the Oklahoma Department of Aerospace and\n\nAeronautics shall be provided for in the appropriation process of\n\nthe Legislature, in addition to any other funding provided by law.\n\nThe expenses incurred by the Oklahoma Department of Aerospace and\n\nAeronautics as a result of the transfer required by this section\n\nshall be paid by the Oklahoma Department of Aerospace and\n\nAeronautics.\n\nE. The division within the Department of Transportation known\n\nas the Oklahoma Aeronautics Commission shall be abolished by the\n\nTransportation Commission after the transfer has been completed.\n\nF. The Director of State Finance is directed to coordinate the\n\ntransfer of assets, funds, allotments, purchase orders, liabilities,\n\noutstanding financial obligations or encumbrances provided for in\n\nthis section.
