Stat. tit. 3, § 3-90","heading":"Construction and repair of airports in various counties -","body":"Minimum runways - Federal funds.\n\nIn order to assure a safe and adequate system of airports within\n\nthis state:\n\n1. In every county wherein there is no active airport, the\n\nOklahoma Department of Aerospace and Aeronautics is authorized to\n\nconstruct within such county or a municipality located therein or\n\nupon land owned by the federal government but under the active\n\ncontrol of the state, county or a municipality located within such\n\ncounty a runway of not less than two thousand six hundred (2,600)\n\nfeet in length and to repair, maintain and hardsurface such runway.\n\n2. In each county wherein there already exists an active\n\nairport owned by such county or a municipality located therein or\n\nupon land owned by the federal government but under the active\n\ncontrol of the state, county or a municipality located within such\n\ncounty, but there does not exist within such county a hardsurfaced\n\nrunway of at least two thousand six hundred (2,600) feet in length,\n\nthe Oklahoma Department of Aerospace and Aeronautics may construct\n\nupon such lands as those described in paragraph 1 of this section a\n\nrunway of not less than two thousand six hundred (2,600) feet and\n\nmay repair, maintain and hardsurface such runway, or may, where\n\nsufficient land is available for such purpose, expand such existing\n\nairport to a length of two thousand six hundred (2,600) feet and may\n\nthereupon repair, maintain and hardsurface the entire runway.\n\n3. During the fiscal year in which federal funds are available\n\nunder the Federal Airport Program for development or improvement of\n\na state, county or city owned or controlled airport, the Oklahoma\n\nDepartment of Aerospace and Aeronautics shall be prohibited from\n\nperforming any construction or major repair work upon such airstrip\n\nunless and until such federal funds have been available for such\n\npurpose.\n\n4. The Oklahoma Department of Aerospace and Aeronautics, in any\n\ncounty where no airport containing two thousand six hundred (2,600)\n\nfeet or more runway exists, is authorized to accept gifts of land to\n\nbe used for a county airport and of money to be used to acquire an\n\nairport.\n\n5.
