Stat. tit. 3, § 3-92","heading":"Lease of state-owned lands for oil, gas, mining and","body":"agricultural purposes.\n\nThe Oklahoma Department of Aerospace and Aeronautics is hereby\n\nauthorized and empowered to offer for sale, sell and execute oil and\n\ngas leases, and other mineral and mining leases, and agricultural\n\nleases on any of the lands of this state under the control and\n\nsupervision of the Department, provided, the development of land for\n\nthe purpose leased will not unduly interfere with the aeronautical\n\npurpose for which said land is being used by the state. The\n\nDepartment is hereby given authority to adopt and promulgate such\n\nadditional rules and regulations, not inconsistent herewith, as it\n\nmay deem necessary and for the best interest of the state in\n\nfacilitating the sale of said leases. It shall be the duty of the\n\nDirector of the Oklahoma Department of Aerospace and Aeronautics to\n\nexecute such leases for and in behalf of the Department, and the\n\nDirector shall be liable on his official bond for failure to\n\nfaithfully discharge his duties hereunder. The sales of all oil,\n\ngas and mineral leases shall be made upon the basis of a retained\n\nroyalty of not less than one-eighth (1/8) of all oil, gas,\n\ncasinghead gas, and other minerals produced from the lands covered\n\nby such leases and such additional cash bonus as may be procured.\n\nProvided, however, if the state owns less than one hundred percent\n\n(100%) of the oil, gas, casinghead gas and other minerals covered by\n\nany such lease, the royalty retained shall not be less than one-\n\neighth (1/8) of the mineral interest so owned. All oil, gas,\n\nmineral and agricultural leases shall be sold only after\n\nadvertisement for a period of three (3) weeks in a legal newspaper\n\npublished and of general circulation in the county in which said\n\nlands are located.
