Stat. tit. 30, § 30-2-108","heading":"Education and maintenance of minor - Income from","body":"property of minor - Guardianship of minor with living parent - Child\n\nsupport.\n\nA. If any minor, having a parent or parents living, has\n\nproperty, the income of which is sufficient for his or her\n\nmaintenance and education in a manner more expensive than such\n\nparent or parents can reasonably afford, regard being had to all of\n\nthe circumstances of the case, the expenses of the education and\n\nmaintenance of such minor may be defrayed out of the income of the\n\nproperty of the minor in whole or in part, as judged reasonable and\n\nas directed by the court. The charges therefor may be allowed\n\naccordingly in the settlement of the accounts of the guardian of the\n\nminor.\n\nB. Except as provided in subsection A of this section:\n\n1. Any order appointing a guardian of the minor who has a\n\nliving parent or other person legally responsible for the support of\n\nthe child shall:\n\na. provide for the payment of child support by each\n\nparent or other responsible party pursuant to the\n\nOklahoma child support guidelines as set forth in\n\nSections 118 and 119 of Title 43 of the Oklahoma\n\nStatutes. Each parent, including parents who reside\n\ntogether, shall be individually ordered to pay the\n\npercentage of the total monthly child support\n\nobligation attributable to that parent, and\n\nb. contain an immediate income assignment provision\n\npursuant to Section 115 of Title 43 of the Oklahoma\n\nStatutes;\n\n2. The court may defer the issue of establishment or\n\nenforcement of child support to the appropriate administrative or\n\ndistrict court when child support services are being provided\n\npursuant to the state child support plan as provided in Section 237\n\nof Title 56 of the Oklahoma Statutes; and\n\n3. Any guardianship or conservatorship for a minor created on\n\nor after December 1, 2000, shall comply with the provisions of this\n\nsubsection. Guardianships or conservatorships for a minor in\n\nexistence prior to December 1, 2000, shall comply with the\n\nprovisions of this subsection as ordered by the court.\n\nC. In any guardianship in which provision is made for the\n\ncustody or support of a minor child or enforcement of an existing\n\ncustody or support order or before hearing the matter or signing any\n\norders, the court shall inquire whether public assistance money or\n\nmedical support has been provided through the Department of Human\n\nServices, hereafter referred to as the Department, for the benefit\n\nof each child, or whether the Department is providing child support\n\nservices pursuant to the state child support plan as provided in\n\nSection 237 of Title 56 of the Oklahoma Statutes. If public\n\nassistance money, medical support, or child support services have\n\nbeen provided for the benefit of the child, the Department shall be\n\na necessary party for the adjudication of the debt due to the state,\n\nas defined in Section 238 of Title 56 of the Oklahoma Statutes, and\n\nfor the adjudication of paternity, child support, and medical\n\ninsurance coverage for the minor children in accordance with federal\n\nregulations. When a guardianship action is filed, the petitioner\n\nshall give the Department notice of the action according to Section\n\n2004 of Title 12 of the Oklahoma Statutes. The Department shall not\n\nbe required to intervene in the action to have standing to appear\n\nand participate in the action.
