Any person interested in the welfare of a person believed to\n\nbe an incapacitated person or partially incapacitated person may\n\nfile a petition alleging that such person is an incapacitated or\n\npartially incapacitated person, and request the appointment of a\n\nguardian.\n\nB. The petition shall be verified and shall specify:\n\n1. The names and addresses of persons entitled to notice\n\npursuant to Section 3-110 of this title and to the attorney of the\n\nsubject of the proceeding, if any, and if known to the petitioner;\n\n2. The nature and degree of the alleged incapacity;\n\n3. The relief requested and the facts and reasons supporting\n\nthe need for such relief including, where applicable, a description\n\nof any acts or behavior of the subject of the proceeding which gave\n\nrise to the allegations; and\n\n4. The estimated value of all intangible personal property of\n\nthe ward.\n\nC. A copy of the results of any physical, psychological or\n\nother appropriate professional evaluation of the condition of the\n\nsubject of the proceeding which has been completed within sixty (60)\n\ndays prior to the filing of the petition, may be attached to the\n\npetition at the time it is filed.\n\nD. A guardianship plan or plans substantially in the form\n\nrequired by Section 3-120 or Section 3-122 of this title or both, as\n\nappropriate, may be attached to the petition at the time it is filed\n\nor may be submitted to the court at the time of the hearing.\n\nE. Before making the appointment, the court may receive an\n\ninvestigation and report regarding the background and home of the\n\nprospective guardian. When required, the investigation and report\n\nof the prospective guardian and placement restrictions and\n\nrequirements shall include a check for the petitioner and each adult\n\nmember of the petitioner’s household establishing that there is no\n\nrecord of a criminal conviction, protective order or pending\n\ncriminal charge. Additionally, the report shall include an Oklahoma\n\nState Bureau of Investigation name-based criminal background check\n\nfor the petitioner and each adult member of the petitioner’s\n\nhousehold establishing that no record of a criminal conviction\n\nexists in the OSBI criminal history repository based on the search\n\ncriteria provided.
