At the hearing on the petition the court shall determine\n\nwhether or not it is necessary to appoint a guardian of the person,\n\nproperty or both. If a guardian is needed, the court shall\n\ndetermine:\n\n1. When a general or limited guardian of the person of the\n\nsubject of the proceeding is requested, the essential requirements\n\nfor the health and safety of the subject of the proceeding and the\n\nskills and knowledge necessary to meet those requirements;\n\n2. When a general or limited guardian of the property of the\n\nsubject of the proceeding is requested, the type and amount of the\n\nfinancial resources of the subject of the proceeding, the essential\n\nrequirements for managing the financial resources and the skills and\n\nknowledge necessary to manage the financial resources;\n\n3. The nature and extent of the incapacity of the subject of\n\nthe proceeding, if any; and\n\n4. Whether by clear and convincing evidence the subject of the\n\nproceeding is an incapacitated or partially incapacitated person.\n\nB. If after a full hearing and examination upon such petition,\n\nthe court finds by clear and convincing evidence that the subject of\n\nthe proceeding is an incapacitated or partially incapacitated\n\nperson, the court shall determine the extent of the incapacity and\n\nthe feasibility of less restrictive alternatives to guardianship to\n\nmeet the needs of the subject of the proceeding. Upon such\n\ndetermination, the court may:\n\n1. Dismiss the action if the court finds that less restrictive\n\nalternatives to guardianship are feasible and adequate to meet the\n\nneeds of the subject of the proceeding; or\n\n2. Appoint a guardian or limited guardian. An order making\n\nsuch an appointment shall include a specific finding that it was\n\nestablished by clear and convincing evidence that the identified\n\nneeds of the subject of the proceeding require a guardianship\n\ninstead of less restrictive alternatives.\n\nC. Guardianship for an incapacitated person shall be:\n\n1. Used only as is necessary to promote and protect the well-\n\nbeing of the person and his or her property;\n\n2. Designed to encourage the development of maximum self-\n\nreliance and independence of the person; and\n\n3. Ordered only to the extent required by the actual mental,\n\nphysical and adaptive limitations of the person.\n\nR.L. 1910, § 6539.
