Stat. tit. 30, § 30-3-124","heading":"Sale or lease of real property by guardian - Approval -","body":"Joinder of spouse.\n\nWhen the ward owns an interest in a tract of real property in\n\naddition to a homestead interest, no conveyance, deed, contract or\n\nlease executed pursuant to the authority granted by Section 3-123 of\n\nthis title shall be valid, unless the sale or leasing be conducted\n\nin the manner provided by law for the sale or leasing of other lands\n\nof an incapacitated or partially incapacitated person, be approved\n\nby the court in which the guardianship proceeding is pending, and\n\nthe spouse of the ward be a party to such conveyance, deed, contract\n\nor lease and join in the execution and acknowledgment thereof, but\n\nwhen the ward owns no interest in a tract of real property other\n\nthan a homestead interest or possible homestead interest, a guardian\n\nmay execute a conveyance thereof on behalf of the ward for the\n\npurpose of waiving such homestead interest or possible homestead\n\ninterest, if so authorized by order of the court in which such\n\nproceeding is pending, made pursuant to application and notice sent\n\nby ordinary mail to the persons set forth in Section 3-110 of this\n\ntitle at least ten (10) days prior to the hearing of such\n\napplication.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6f08696189ba721647682aa3e02a2c6afcb0e8255a4b987c1ab61fc25470fd8f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-3-123","next":"us-ok/okla.-stat.-tit.-30-30-3-125"},"notice":"GroundRules: Original legal text.
