Stat. tit. 30, § 30-3-306","heading":"Definitions - Applicability","body":"(a) In this article:\n\n(1) “Emergency” means a circumstance that likely will result in\n\nsubstantial harm to a respondent’s health, safety, or welfare, and\n\nfor which the appointment of a guardian is necessary because no\n\nother person has authority and is willing to act on the respondent’s\n\nbehalf;\n\n(2) “Home state” means the state in which the respondent was\n\nphysically present, including any period of temporary absence, for\n\nat least six (6) consecutive months immediately before the filing of\n\na petition for a protective order or the appointment of a guardian;\n\nor if none, the state in which the respondent was physically\n\npresent, including any period of temporary absence, for at least six\n\n(6) consecutive months ending within the six (6) months prior to the\n\nfiling of the petition; and\n\n(3) “Significant-connection state” means a state, other than\n\nthe home state, with which a respondent has a significant connection\n\nother than mere physical presence and in which substantial evidence\n\nconcerning the respondent is available.\n\n(b) In determining under Section 8 and subsection (e) of\n\nSection 15 of this act whether a respondent has a significant\n\nconnection with a particular state, the court shall consider:\n\n(1) The location of the respondent’s family and other persons\n\nrequired to be notified of the guardianship or protective\n\nproceeding;\n\n(2) The length of time the respondent at any time was\n\nphysically present in the state and the duration of any absence;\n\n(3) The location of the respondent’s property; and\n\n(4) The extent to which the respondent has ties to the state\n\nsuch as voting registration, state or local tax return filing,\n\nvehicle registration, driver license, social relationship, and\n\nreceipt of services.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"98e5bfb87e3e847981daf3ae34621b3255da3a7250f392f51556f73a1aea03a2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-3-305","next":"us-ok/okla.-stat.-tit.-30-30-3-307"},"notice":"GroundRules: Original legal text.
