Stat. tit. 30, § 30-3-308","heading":"Jurisdictional requirements for appointing a guardian or","body":"issuing a protective order.\n\nA court of this state has jurisdiction to appoint a guardian or\n\nissue a protective order for a respondent if:\n\n(1) This state is the respondent’s home state;\n\n(2) On the date the petition is filed, this state is a\n\nsignificant-connection state and:\n\n(A) the respondent does not have a home state or a court\n\nof the respondent’s home state has declined to\n\nexercise jurisdiction because this state is a more\n\nappropriate forum, or\n\n(B) the respondent has a home state, a petition for an\n\nappointment or order is not pending in a court of that\n\nstate or another significant-connection state, and,\n\nbefore the court makes the appointment or issues the\n\norder:\n\n(i) a petition for an appointment or order is not\n\nfiled in the respondent’s home state,\n\n(ii) an objection to the court’s jurisdiction is not\n\nfiled by a person required to be notified of the\n\nproceeding, and\n\n(iii) the court in this state concludes that it is an\n\nappropriate forum under the factors set forth in\n\nSection 11 of this act;\n\n(3) This state does not have jurisdiction under either\n\nparagraph (1) or (2) of this subsection, the respondent’s home state\n\nand all significant-connection states have declined to exercise\n\njurisdiction because this state is the more appropriate forum, and\n\njurisdiction in this state is consistent with the constitutions of\n\nthis state and the United States; or\n\n(4) The requirements for special jurisdiction under Section 9\n\nof this act are met.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fc750fa559e4f1493ee34d4c1477fe22cd5dbccbf80078f5f0a3131df180f545","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-3-307","next":"us-ok/okla.-stat.-tit.-30-30-3-309"},"notice":"GroundRules: Original legal text.
