Stat. tit. 30, § 30-3-311","heading":"Factors for declining jurisdiction","body":"(a) A court of this state having jurisdiction under Section 8\n\nof this act to appoint a guardian or issue a protective order may\n\ndecline to exercise its jurisdiction if it determines at any time\n\nthat a court of another state is a more appropriate forum.\n\n(b) If a court of this state declines to exercise its\n\njurisdiction under subsection (a) of this section, it shall either\n\ndismiss or stay the proceeding. The court may impose any condition\n\nthe court considers just and proper, including the condition that a\n\npetition for the appointment of a guardian or issuance of a\n\nprotective order be filed promptly in another state.\n\n(c) In determining whether it is an appropriate forum, the\n\ncourt shall consider all relevant factors, including:\n\n(1) Any expressed preference of the respondent;\n\n(2) Whether abuse, neglect, or exploitation of the respondent\n\nhas occurred or is likely to occur and which state could best\n\nprotect the respondent from the abuse, neglect, or exploitation;\n\n(3) The length of time the respondent was physically present in\n\nor was a legal resident of this or another state;\n\n(4) The distance of the respondent from the court in each\n\nstate;\n\n(5) The financial circumstances of the respondent’s estate;\n\n(6) The nature and location of the evidence;\n\n(7) The ability of the court in each state to decide the issue\n\nexpeditiously and the procedures necessary to present evidence;\n\n(8) The familiarity of the court of each state with the facts\n\nand issues in the proceeding; and\n\n(9) If an appointment were made, the court’s ability to monitor\n\nthe conduct of the guardian or conservator.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f89f584800398b13f1e782d0f889017705c598d80bfaef8dea925ecd7c029c19","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-3-310","next":"us-ok/okla.-stat.-tit.-30-30-3-312"},"notice":"GroundRules: Original legal text.
