Stat. tit. 30, § 30-3-312","heading":"Jurisdiction acquired through unjustifiable conduct","body":"(a) If at any time a court of this state determines that it\n\nacquired jurisdiction to appoint a guardian or issue a protective\n\norder because of unjustifiable conduct, the court may:\n\n(1) Decline to exercise jurisdiction;\n\n(2) Exercise jurisdiction for the limited purpose of fashioning\n\nan appropriate remedy to ensure the health, safety, and welfare of\n\nthe respondent or the protection of the respondent’s property or\n\nprevent a repetition of the unjustifiable conduct, including staying\n\nthe proceeding until a petition for the appointment of a guardian or\n\nissuance of a protective order is filed in a court of another state\n\nhaving jurisdiction; or\n\n(3) Continue to exercise jurisdiction after considering:\n\n(A) the extent to which the respondent and all persons\n\nrequired to be notified of the proceedings have\n\nacquiesced in the exercise of the court’s\n\njurisdiction;\n\n(B) whether it is a more appropriate forum than the court\n\nof any other state under the factors set forth in\n\nsubsection (c) of Section 11 of this act; and\n\n(C) whether the court of any other state would have\n\njurisdiction under factual circumstances in\n\nsubstantial conformity with the jurisdictional\n\nstandards of Section 8 of this act.\n\n(b) If a court of this state determines that it acquired\n\njurisdiction to appoint a guardian or issue a protective order\n\nbecause a party seeking to invoke its jurisdiction engaged in\n\nunjustifiable conduct, it may assess against that party necessary\n\nand reasonable expenses, including attorney fees, investigative\n\nfees, court costs, communication expenses, witness fees and\n\nexpenses, and travel expenses.
