Stat. tit. 30, § 30-3-316","heading":"Confirmation of transfer of guardianship or","body":"conservatorship.\n\n(a) To confirm transfer of a guardianship or conservatorship\n\ntransferred to this state under provisions similar to Section 15 of\n\nthis act, the guardian or conservator shall petition the court in\n\nthis state to accept the guardianship or conservatorship. The\n\npetition shall include a certified copy of the other state’s\n\nprovisional order of transfer.\n\n(b) Notice of a petition under subsection (a) of this section\n\nshall be given to those persons that would be entitled to notice if\n\nthe petition were a petition for the appointment of a guardian or\n\nissuance of a protective order in both the transferring state and\n\nthis state. The notice shall be given in the same manner as notice\n\nis required to be given in this state.\n\n(c) On the court’s own motion or on request of the guardian or\n\nconservator, the incapacitated or protected person, or other person\n\nrequired to be notified of the proceeding, the court shall hold a\n\nhearing on a petition filed pursuant to subsection (a) of this\n\nsection.\n\n(d) The court shall issue an order provisionally granting a\n\npetition filed under subsection (a) of this section unless:\n\n(1) An objection is made and the objector establishes that\n\ntransfer of the proceeding would be contrary to the interests of the\n\nincapacitated or protected person; or\n\n(2) The guardian or conservator is ineligible for appointment\n\nin this state.\n\n(e) The court shall issue a final order accepting the\n\nproceeding and appointing the guardian or conservator as guardian or\n\nconservator in this state upon its receipt from the court from which\n\nthe proceeding is being transferred of a final order issued under\n\nprovisions similar to Section 15 of this act transferring the\n\nproceeding to this state.\n\n(f) Not later than ninety (90) days after issuance of a final\n\norder accepting transfer of a guardianship or conservatorship, the\n\ncourt shall determine whether the guardianship or conservatorship\n\nneeds to be modified to conform to the law of this state.\n\n(g) In granting a petition under this section, the court shall\n\nrecognize a guardianship or conservatorship order from the other\n\nstate, including the determination of the incapacitated or protected\n\nperson’s incapacity and the appointment of the guardian or\n\nconservator.\n\n(h) The denial by a court of this state of a petition to accept\n\na guardianship or conservatorship transferred from another state\n\ndoes not affect the ability of the guardian or conservator to seek\n\nappointment as guardian or conservator in this state under Section\n\n3-101 of Title 30 of the Oklahoma Statutes if the court has\n\njurisdiction to make an appointment other than by reason of the\n\nprovisional order of transfer.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e25c50c66c2fd6511940e671f2a31ffea8798f83c24a933f882ba34130472ab7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-3-315","next":"us-ok/okla.-stat.-tit.-30-30-3-317"},"notice":"GroundRules: Original legal text.
