Stat. tit. 30, § 30-31","heading":"Definitions — Court order for inpatient mental health","body":"treatment — Criteria.\n\nA. As used in this act:\n\n1. \"General guardianship\" means a relationship where a person\n\nhas been appointed by a court to serve as the guardian of an\n\nincapacitated person to ensure that the essential requirements for\n\nthe health and safety of the person are met, to manage the estate or\n\nfinancial resources of the person, or both;\n\n2. \"Gravely disabled\" means a condition in which a person,\n\nbecause of a mental illness, is unable to provide for his or her\n\nbasic personal needs for food, clothing, or shelter;\n\n3. \"Inpatient mental health treatment\" means a treatment\n\nservice offered or provided for a continuous period of more than\n\ntwenty-four (24) hours in residence after admission to a mental\n\nhealth or substance abuse treatment facility for the purpose of\n\nobservation, evaluation, or treatment; and\n\n4. \"Ward\" means a person over whom a guardian is appointed and\n\na person over whose property a guardian or conservator is appointed.\n\nB. A guardian who has general guardianship and who has obtained\n\nan order by a court for inpatient mental health treatment for the\n\nward may apply for an order requiring either municipal or county\n\nofficials to retrieve, only if in an unsheltered environment, and\n\ndeliver the gravely disabled ward to an inpatient treatment\n\nfacility, pursuant to Section 1-110 of Title 43A of the Oklahoma\n\nStatutes, when one of the following criteria is met:\n\n1. The ward is unable to utilize the means available to provide\n\nfor his or her basic personal needs regarding food, clothing, or\n\nshelter. Considerations that shall be made when making this\n\nevaluation shall include, but not be limited to, the following:\n\na. whether lab examinations reveal signs of malnutrition\n\nor dehydration,\n\nb. whether there is observed, documented behavior showing\n\nan inability to consume adequate amounts of food or\n\nwater due to a mental illness,\n\nc. whether there is a history of public nudity or\n\ninadvertent exhibitionism which has been observed and\n\ndocumented and is due to a mental illness,\n\nd. the existence of physical evidence of exposure to the\n\nenvironment due to mental illness symptoms which\n\nprevent the ward from wearing adequate clothing,\n\ne. whether there is observed behavior and symptoms of a\n\nmental illness which prevent the ward from utilizing\n\nor obtaining adequate shelter,\n\nf. the existence of a repeated and recent history of\n\nfailure to maintain adequate shelter in the community\n\ndue to behaviors and symptoms of a mental illness, or\n\ng. evidence of a failure to maintain a shelter in a\n\nmanner that is safe to live in, due to symptoms of a\n\nmental illness;\n\n2. The ward is unable to voluntarily request and receive\n\nassistance for his or her basic personal needs; or\n\n3. The ward is unable to survive safely without involuntary\n\ndetention and does not have the help of family members, friends, or\n\nothers to provide the ward's basic personal needs regarding food,\n\nclothing, or shelter.\n\nC.
