An attorney, other than a public defender, for a ward or\n\na subject of a proceeding pursuant to the Oklahoma Guardianship and\n\nConservatorship Act or whose services are obtained by a guardian on\n\nbehalf of a ward is entitled to reasonable compensation to be paid\n\nfrom and as a charge against the estate of the ward. Reasonable\n\ncompensation for attorney services rendered and expenses made on\n\nbehalf of the guardian of the ward incurred prior to the appointment\n\nof the guardian may be paid from and charged against the estate of\n\nthe ward, as approved by the court prior to payment.\n\n2. Guardians ad litem, other than an employee of a public\n\nagency or an employee of a private agency which provides such\n\nservice pursuant to a contract with a public agency, appointed\n\npursuant to the provisions of this act are entitled to reasonable\n\ncompensation.\n\n3. A person conducting an evaluation of the subject of the\n\nproceeding, whose services resulted in the appointment of a limited\n\nguardian or guardian or other order beneficial to the subject of the\n\nproceeding, is entitled to reasonable and necessary compensation.\n\nB. 1. Compensation and reimbursements pursuant to this section\n\nshall be paid from the financial resources of the subject of the\n\nproceeding unless the court determines that such payment of\n\ncompensation and reimbursements would:\n\na. substantially impede the partially incapacitated or\n\nincapacitated person from meeting the essential\n\nrequirements for his physical health or safety, and\n\nb. substantially impair the financial resources of such\n\nperson, or substantially impede his ability to obtain\n\nthe services necessary for developing or regaining his\n\nabilities to the maximum extent possible.\n\n2. If not otherwise compensated or reimbursed pursuant to the\n\nprovisions of paragraph 1 of this subsection:\n\na. any attorney or guardian ad litem appointed by the\n\ncourt who is entitled to compensation shall be\n\ncompensated from the court fund of the court having\n\njurisdiction,\n\nb. the cost of services provided by a person conducting\n\nan evaluation, when such person is the employee of a\n\npublic agency or the employee of a private agency\n\nwhich provides such services for guardianship\n\nproceedings pursuant to an agreement with a public\n\nagency, shall be borne by the public agency, or by the\n\nprivate agency in accordance with the terms of such\n\nagreement, and\n\nc. if the person conducting an evaluation is a private\n\nindividual or agency and the cost of the services\n\nprovided is not otherwise compensable under a state or\n\nfederal public assistance program, compensation for\n\nthe cost of services shall be from the court fund of\n\nthe court having jurisdiction.\n\n3. Compensation or reimbursement from the court fund for\n\nattorneys and guardian ad litem pursuant to the provisions of this\n\nsubsection shall be in accordance with the provisions of Section\n\n1304 of Title 20 of the Oklahoma Statutes.\n\nC. All compensation and reimbursements pursuant to the\n\nprovisions of this section shall be approved by the court prior to\n\npayment.\n\nD. Contingent fees and contracts for recovery of property\n\nagreed upon and approved by courts or the ranking official\n\nrepresenting the Secretary of the Interior in Oklahoma, who has\n\nsupervision of any restricted Indian tribe in this state do not come\n\nwithin the provisions of the Oklahoma Guardianship and\n\nConservatorship Act.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"aa18d5f241594c61c43928ae183dff89c3c923dbb206280c2a4ba94f71fabf28","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-4-402","next":"us-ok/okla.-stat.-tit.-30-30-4-404"},"notice":"GroundRules: Original legal text.
