Notwithstanding any other provision contained in the\n\nOklahoma Guardianship and Conservatorship Act, a guardian or limited\n\nguardian of the property of a ward may sell, at public auction or\n\nprivate sale, without obtaining prior court authorization for sale,\n\nwithout filing a return of sale, and without obtaining court\n\nconfirmation of sale, any personal property of the ward which is\n\nperishable, is otherwise likely to depreciate in value, or would\n\ncause the estate of the ward to incur loss or expense if kept.\n\nTitle to such property shall pass to the purchaser thereof without\n\napproval of or confirmation by the court of such sale.\n\nB. With respect to a limited guardian of the property, this\n\nsection shall apply only to property of the ward which is subject to\n\nsuch limited guardian's control pursuant to a dispositional order.\n\nC. Any sale of property made by a guardian or limited guardian\n\nof the property of a ward pursuant to this section shall be reported\n\nin the accounting next filed by such guardian or limited guardian\n\nafter the making of the sale. If the court determines the property\n\nsold was not perishable or was not otherwise likely to depreciate in\n\nvalue and would not have caused the estate of the ward to incur loss\n\nor expense if kept, the guardian or limited guardian who made such\n\nsale shall not be surcharged or otherwise held liable with respect\n\nto such sale if he made a reasonable determination in good faith\n\nthat the property sold was perishable, was otherwise likely to\n\ndepreciate in value, or would have caused the estate of the ward to\n\nincur loss or expense if kept.","path":["OK Code","Title 30"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os30.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c8a93eca47f67bb412f213831fdc0fcd526d006b08c2ff268949b0930bb52e8e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-30-30-4-768","next":"us-ok/okla.-stat.-tit.-30-30-4-770"},"notice":"GroundRules: Original legal text.
