Stat. tit. 30, § 30-4-903","heading":"Reporting of abuse, neglect or exploitation - Violation","body":"and penalty - Civil liability.\n\nA. 1. Any person having reasonable cause to believe that an\n\nincapacitated person, a partially incapacitated person, or a minor\n\nis suffering from abuse, neglect, or exploitation shall make a\n\nreport to the Department of Human Services, the office of the\n\ndistrict attorney in the county in which the suspected abuse,\n\nneglect, or exploitation occurred, or the local municipal police\n\ndepartment or sheriff's department as soon as such person is aware\n\nof the situation.\n\n2. With regard to minors, the use of ordinary force as a means\n\nof discipline pursuant to Section 844 of Title 21 of the Oklahoma\n\nStatutes shall not constitute abuse.\n\n3. Reports regarding the abuse, neglect, or exploitation of an\n\nincapacitated person, or a partially incapacitated person shall be\n\nmade and shall be governed by the provisions of the Protective\n\nServices for Vulnerable Adults Act. Reports regarding the abuse,\n\nneglect, or exploitation of a minor shall be made and shall be\n\ngoverned by the Oklahoma Child Abuse Reporting and Prevention Act.\n\nB. Any person who knowingly and willfully fails to promptly\n\nreport any abuse, neglect, or exploitation as required by the\n\nprovisions of subsection A of this section, upon conviction, shall\n\nbe guilty of a misdemeanor.\n\nC. Any person participating in good faith and exercising due\n\ncare in the making of a report pursuant to the provisions of this\n\nsection shall have immunity from any civil or criminal liability\n\nthat might otherwise be incurred or imposed. Any such participant\n\nshall have the same immunity with respect to participation in any\n\njudicial proceeding resulting from such report.\n\nD. Any person who willfully or recklessly makes a false report\n\nor a report without a reasonable basis in fact for such a report\n\npursuant to the provisions of this section shall be civilly liable\n\nfor any actual damages suffered by the person or persons being\n\nreported and for any punitive damages set by the court or jury which\n\nmay be allowed in the discretion of the court or jury.\n\nE. No employer shall terminate the employment, prevent or\n\nimpair the practice or occupation of, or impose any other sanction\n\non any employee solely for the reason that the employee made or\n\ncaused to be made a report or cooperated with an investigation\n\npursuant to the provisions of this section.
