The homestead of any person in this state, not within any\n\ncity or town, shall consist of not more than one hundred sixty (160)\n\nacres of land, which may be in one or more parcels, to be selected\n\nby the owner.\n\nB. Effective November 1, 1997, the homestead of any person in\n\nthis state, not within any city or town, annexed by a city or town\n\non or after November 1, 1997, owned and occupied and used for both\n\nresidential and commercial agricultural purposes shall consist of\n\nnot more than one hundred sixty (160) acres of land, which may be in\n\none or more parcels, to be selected by the owner.\n\nC. The homestead of any person within any city or town, owned\n\nand occupied as a residence only, or used for both residential and\n\nbusiness purposes, shall consist of not exceeding one (1) acre of\n\nland, to be selected by the owner. For purposes of this subsection,\n\nat least seventy-five percent (75%) of the total square foot area of\n\nthe improvements for which a homestead exemption is claimed must be\n\nused as the principal residence in order to qualify for the\n\nexemption. If more than twenty-five percent (25%) of the total\n\nsquare foot area of the improvements for which a homestead exemption\n\nis claimed is used for business purposes, the homestead exemption\n\namount shall not exceed Five Thousand Dollars ($5,000.00).\n\nD. Nothing in the laws of the United States, or any treaties\n\nwith the Indian tribes in the state, shall deprive any Indian or\n\nother allottee of the benefit of the homestead and exemption laws of\n\nthe state.\n\nE. Any temporary renting of the homestead shall not change the\n\ncharacter of the same, when no other homestead has been acquired.\n\nR.L. 1910, § 3343.
